    Ok truck update. It seems that the guy is going to be paying this week so I should be getting my truck back on the weekend! It has been a long haul going through all this crap but I am hoping it is all worked out soon.

    I figure my gas money savings could be put towards some new additions! Any suggestions?

    Did your bank secure your loan with the truck or did you just use an unsecured loan to buy it like a line of credit?

    Not sure the rules in your state, but your bank may be at fault and you may be entitled to sue them for damages (cost of a rental car, time from work dealing with it, etc). It is the lender's responsibility to do due diligence when lending on anything secured to avoid scams. Good luck to you, sir. And hopefully this is a good lesson for everyone who's read this post, that no one, not banks, police officers, friends, government agencies, deserves the benefit of the doubt. The most powerful weapon you can have in your arsenal is knowledge.

    Well actually I am in Edmonton. My truck is currently in Calgary and was set for auction tomorrow, however the douche ended up paying.

    I am not sure what I can get out of this, however I am current;y looking into it.

    And yes let this be a lesson to all.

    How does Canada handle proof of ownership? Is it the same as titling a vehicle in the USA?
    Do they title vehicles?
    Does the l/holder's name appear on the title?
    What proof of ownership does Canada require to apply for tags and insurance?

    There is no titling in Alberta (Didn't realize you were an Alberta boy!).

    Essentially, when you sell a car, you need to sign the back of your registration, and it's up to the buyer/seller if you want to complete a bill of sale. Our registries are privatized (no DMV!) and re-registering a car after you purchase takes about 5 minutes.

    However, the Albertan rules for loans are what i described. Unless you used a line of credit or another unsecured means of paying for it, your bank is at fault for not running a lien check against the VIN of the new truck.

    Let me know if there's anything i can do.

    Well I am not sure what you can haha, Except maybe going on a window smatshing drive down in south Calgary! Yea I used a bank and the truck is on my loan as collateral, so realistically they shouldn't have even given me the loan without making sure the first lein was removed!

    Well finally got my truck back today! It was a long haul but the guy finally paid it off and I got it back. The auction hall also shampooed my carpets and shined my tires. Now I get on that list of mods I have created while waiting. Also have to get to work on sueing that bastard in order to pay for all of my new mods.

    No actual lawyer involvement, I just went for legal advice on how I should handle it. Since I really wanted my truck, I waited to get him to pay it off. Now I have a series of records to take him to small claims court for about $4000 for my expenses while not having a truck.

    Something not right with all this. As rutherk1 stated, NO ONE can get a valid title issued unless they submit a PAID LIEN TITLE that is issued by the lender, in this case Toyota Credit. Did the guy you bought the truck from give you a paid title, or a title with lien still on it????
