    Shooting of burglary suspect unjustified, family says

    DENVER - Relatives of the teenager killed during an attempted burglary in Denver early Monday do not believe the shooting was justified.

    They are not making any excuses for 17-year-old Marcus Duran, but question the actions of the homeowner.

    "So he was doing wrong, why does he deserve to get shot in the head two, three times?" said Duran's godmother, Phyllis Chavez

    The homeowner shot and killed Duran during an attempted burglary early Monday morning, Denver Police said.

    Police spokesman Sonny Jackson said officers responded to a 911 call from a home in the 3100 block of Gaylord St. at 2:20 a.m. when they heard gunshots at a house across the street.

    "Officers went to 3150 Gaylord Street and found one male who appeared to be suffering from a gun shot wound," Jackson said. "He was pronounced dead at the scene."

    Police found Duran, lying on the porch. The coroner said he died from multiple gunshot wounds to the head.

    Another suspect was taken into custody for attempted burglary while a third remained at-large.

    The homeowner was taken into custody and later released. The Denver District Attorney's Office will determine if the shooting was justified under Colorado's "Make My Day" law, which allows people to use deadly force to protect themselves from intruders in their own homes.

    "They are using the Make My Day Law, and it's not Make My Day if he was on the porch," said Duran's grandmother, Paula Gonzales.

    To answer your question: "So he was doing wrong, why does he deserve to get shot in the head two, three times?" It was beacause he WAS DOING WRONG!!

    people are always looking for others to blame. This young man broke into someone elses home and tried to take things that didnt belong to him. As far as the homeowner knew someone was in house and they were going to kill him and rape his wife. I would have done the same thing.

    He knew walking into that house at 3 in the morning that there was a chance that the homeowner had a gun. The situation sucks, but that kid knew what could happen. They are luck in the fact that all 3 of them were not shot dead.

    SAME HERE!!!:mad: Okay you got 3 guys in your home at 3 in the morning. What are their intentions???:confused: For all the homeowner knew, they could have been there to murder his family....rape his wife or daughters....kidnap his children....etc...etc...I think it was completely justified that this young kid got shot. I would have done the same, I wouldnt shoot to injure, I would shoot to kill!!! I mean, to bad for the kids family but if he was raised right, they wouldnt have this problem they have now.:cool:

    Completely justified!! I just hope the law is on the home owner’s side since he was only on the porch and not in the house. I would have done the same. We all have the right to SELF PRESERVATION

    You better get frontal shots on all three and there better be evidence you engaged all 3 inside the structure, unless you want to be posting from a state-provided computer.
    Taking down a perp who's running away from you is just what the Prosecutor wants.
    You: It was self defense!
    PA: They were running away....Now get in the cell.

    As a gun owner and citizen that wants to stay out of jail, you may want to think a little more.

    However this reminded me for some reason of an incident that happened at a bank out here a few years ago.
    A construction worker was getting some money out of an ATM when he was held up at gun point. The BG took his money and ran.
    The CW ran to his truck, grabbed his pistol and shot the BG in the leg (went on through the other leg as well) as he was running away to his car.
    No charges for the CW. I was pretty happy with that outcome.

    Mostly stock for now, I have added a cb radio, various cheap mods and I plan on adding aftermarket wheels and other items in the future.
    Relax there "thinkingman", I think Keason1 was just making a point about someone breaking in into his house. Nothing about what you were talking about.
    He never said anything about shooting someone in the back. lol

    If I was about to become the victim of a home invasion I would have done the exact same thing. At what point do you try to argue with the invaders? Gee, let me see if I can determine just how hostile they're going to be... yeah right!

    I feel absolutely nothing for the kid that died. I am not sure I would have shot the kid in the head 2 or 3 times but thats why the chest area is bigger.

    I hope the homeowner's legal issues are over. Because of a stupid act of a kid, the homeowner will have to live the rest of his life knowing that he did take the life of a young person.

    Now all we need to hear that the dead kid's parents are trying to sue the homeonwer....

    The use of "attempted burglary" and the grandmother's comment about the porch makes me wonder if they ever even made it into the house.

    Personally, I wouldn't shoot anyone who didn't actually break into my house. Call the cops and only shot if they get inside.

    Just my $.02 though

    i wish we had these kind of laws in Ontario, Canada here if someone breaks into your house you have to use equal and justified force therefore he comes in empty handed you have to as well, he comes in with a knife you can go get a knife and if he comes in with a gun you can go get your gun but you may only wound him if he wounds you its stupid as hell to be honest i mean there are ways around certain things but its ridiculous and they make us keep our firearms so secure trigger locked, in a locker, ammunition locked in a separate places that by the time you were able to access your gun its all over anyway
