If you got the subpoena is it a legal requirement to show up?

I'd love to give my support but that's an extremely busy time of year for work and Collingwood is a bit of a drive.

from my understanding, if you are subpoenaed and do not go, you could be charged.

its not a summons asking you to go to court if you can, but an obligation to go to court.

I'd follow up with a lawyer or ask the OPP who subpoenaed you to be sure, but quick google search says you have to go or you can be charged.

From my understanding, you are legally obliged to go to court and your employer must still pay you for missing days, if you are self employed the court compensates you for your missing days.

I had to file for compensation when I went to court missing 2 days of work. There is office for that( at least in Mississauga court), just ask receptionist.

I just got a call from one of the officers saying that I didn't have to attend. The crown will call me at some point and there will be restitution. Interesting development.

Wow. The plot thickens. Wonder if they are going to be calling everyone to let them know...no point in the case I guess?

That's what I thought happened for the case to be cancelled. Seems odd that he's paying his debts. I'll believe it when I see it.
Maybe that's another scam so thru let him go and he doesn't pay again. Lol

Oh I don't think one wants to walk shady against a court order...Contempt of court is even a bigger deal that his previous deal mongering. Now, what court order may be in place I don't know, but declaring bankruptcy invokes the old adage "can't get blood from a stone" ... I'd get my ducks in order quickly

Huh. Interesting. So it sounds like he plead out then and has to pay restitution? I'm fairly sure bankruptcy doesn't get you out of court ordered personal settlements. That being said if he can't pay it could be a while, if ever, before anyone sees a dime.

How do courts hold him accountable? Is there a timeframe?

They will likely determine his ability to pay and base it off of that. For example if the court has awarded $10k to 10 people and the court figures he can pay $100 a month, you'll get $10 a month until $1k has been repaid to you. That's just an example with easy numbers, obviously people will get a share proportional to the claims and the court award. If he misses payments you can take him back to court to collect and they'll seize his bank account or garnish his wages, but you would have to pay a lawyer to go that far.

What I'm trying to say is that if he's honest and cares about his record and ability to work he will pay some money back over time as determined by the court. If he doesn't care he could choose not to pay and pray no one comes after him.

If that's the case then what kind of justice system do we have? Why is the onus on us to go after him?

Think about women who divorce a guy because he keeps his dick wet in someone else and end up going through the same process. Literally if you're entitled to alimony or child support and your partner won't pay it's up to you to take them to court and get the money.
