    If the pedestrian is in blatant conflict with due traffic control devices, then they waive their right of way.

    You have a good point. I wonder how heavy the person was. They usually they go up, damage the front end and slam into the windshield.

    Wow, that crash is local to me. Very familiar with that intersection. For context, that is literally the busiest intersection in Vancouver. Jaywalking there outside the crosswalk would be suicide since there's always a ton of traffic. Doing it at night in the dark is even worse.

    I hate to jump to conclusions, but based on the area and the description of the accident there's a high likelihood this was a homeless person, and intoxication on the part of the pedestrian would not surprise me at all.

    Extremely unlikely there will be any criminal prosecution or charges against the driver, unless the driver was on drugs/alcohol. However, it's highly likely that there will be a civil lawsuit by the pedestrian or their family blaming the driver for not seeing them and stopping. In WA state if they can convince a jury that the driver was partially at fault, they can recover a percentage of their damages. Even if the jury says the pedestrian is 95% at fault and the driver is 5% at fault, the driver has to pay 5% of the pedestrian's damages.

    According to photo, it look's like driver of green Tacoma, don't have "dash cam." Never know, can be CYA problem.;)

    Very true. I read about accidents on Mill Plain frequently. Just don’t normally see a smashed Tacoma.

    Get people in my location. Think they own the road, walking anyplace, no give a shirt, if tresspassing. Also, like no bother looking before cross street, wear headphones, etc., and go! Unless blow horn, then get their attention!:rolleyes:
