What should I do? Sue them or not?

    I bought a 2019 used Tacoma at a genuine Toyota dealership here in KY (I wont say which one here),....Its a "certified preowned" and in pristine shape....

    I spent $1600+ on the "Platinum warranty" and have in writing both the contract and HIS writing that (i got it used with 44,000 miles on it) that i have EITHER 8 years or until 144,000 miles.

    Well a month later (past few days), i never got the contract (the formal one in the mail), i call the dealership, he lies 3 times, never calls me back ....
    so i call HIS BOSS, proved he lied to me, well it gets WORSE,.....turns out the contract cant be validated, because the YEARS he promised AND ALSO the miles, can be ONLY a maximum of 100,000 miles or 6 years.

    THEFT BY DECEPTION, ILLEGAL BREACH OF CONTRACT, and im really pissed! This is a large well known Toyota dealership. :duh:

    So this is illegal, breach of contract, they KNOW IT,....theyre discussing what to do, im FUMING MAD, so mad i could spit blood :annoyed::annoyed:

    any ideas, any help????? I got the contract PROVING they lied to me like a dirty dog.

    If you have it in writing, you should have a good legal case. Can you prove it was they who wrote it?

    more than likely they will offer the 6yr/100k or refund your money and you'll get nothing. Suing them will cost you more than it would be worth, and that's assuming that you would then get the 8yr/144k. If you lost the case then you cost yourself a lot of money with nothing to show for it.

    10000% proof, ive got them utterly 'nailed to the wall' on the contract, they ADMIT THEY WROTE IT etc.

    I wonder if theres some "BIG CHEESE" I can go to above ALL their heads to get this shiz 'fixed'

    I havent been THIS ANGRY in nearly 20 years. So pissed. :violent:

    Went from 3rd Gen Taco to 3GT4R to 2nd Gen Taco and finally a V8 4GT4R.
    Sounds like the guy you dealt with didn’t know the warranty runs in parallel and not adds on to existing mileage and years. Sounds like he added the 2 years of your vehicle on top of the existing mileage (6 years to 8 years/44K to 144K miles)

    Yes, and i asked his boss if this fool was NEW........he said "No, hes been here for YEARS" .... He needs to be fired, that kind of filth will very FAST ruin their reputation.

    I would probably pursue it in small claims if you did. Most small claims go up to $5K. They probably can not extend it past the 6yr/100K, but there is an implied value to the 44K miles that you can seek damages for. But, it may be wirttien into the contract that it can be terminated by them as well, and then, yeah, a refund is all you'll get.

    They got your dough. They’re gonna turn you over to corporate momentarily. From my anecdotal experiences, Toyota Inc. is better than most, but still 50/50 on whether or not they’ll honor the promised, extended, warranty. You might get some of your platinum cash back, and a slightly extended warranty, like a year and 10K miles over factory, but a lawyer will only get a marginally better deal, take a year or more and keep about 10% of any compensation you might receive…

    Offer them this deal: 6 yr/ 100000 warranty at a decent discount. You paid $1600 for 8 yrs/144000 miles. So tell them they give you the 6 yr/100000 for $1000, see what they counter offer.

    Yes, i thought of that as well, and take it out of that fools paycheck for lying to me like a lying dog.

    if you have a loan, call your bank, it’s really their truck/asset, they might want the contract they backed enforced…. maybe.

    alas no, i paid outright for it..... I TRUST NOBODY, EVER, but i never guessed these jokers would lie to me and put it in a contract.........I was wrong, i should update that to "never ever ever ever trust ANYONE ever !!!" ROFL

    meaning i have the contract they wrote for my years and miles, for the Platinum warranty.........they wrote it, they know they did, they admit they did,.....but NOW, oh wait, "yeah we couldnt write a contract for THAT LONG and THAT MANY miles".

    theres the contract they wrote

    and the "final paperwork" generated by Toyota and mailed to you.

    It’s 1600, take them to small claims court and sue them for what you paid, filing fees, and any real costs to bring the case to court. You don’t need a lawyer, no one is going to jail, and you’ll be made whole if you win. It would behoove the dealer to refund your money, throw some extras at you for the trouble, and apologize. The lost wages and any legal consultation will cost them far more. But hey, sometimes they knuckle down and go full moron. There’s no point dealing with them if they don’t fix it right away. They’re just trying to frustrate you enough, you’ll go away. Or they are trying to burn down the time frame you have to respond to this.
    If you go small claims, make sure you can demonstrate proof of your claim and not a bunch of hearsay, nonsense, and emotion. If the dealer no-shows, you win without having to say a thing.
    My wife has to take people into small claims periodically, it’s not a big deal.
