    So, you have a contract.

Copy it, send it to Toyota, Inc. with a letter asking them where your registered/validated warranty documentation is. Copy the dealer, your local DA, Local Representative, State Dept. of Transportation, State Senator and Chamber of Commerce.

Include the name of the dude.

If the warranty in your certified used contract is the same as a new car warranty, then you can cancel it and get a refund, I believe up to 60 days from the contract (and pro rated after that). I would do that if you can, and just enjoy the truck. It’s a Toyota, no need to prepay for problems that aren’t likely to even happen before the extended warranty expires.

If this is a Toyota Certified VSA it's fully cancellable in the first 30 days minus a $50 processing fee. After 30 days it's prorated. Tell them either they cancel it and make up any difference so you're made whole for the $1,695 or you will file a complaint with the KY Motor Vehicle Commission against their dealership license and against the individual salesman's Motor Vehicle Salesperson's License. This is the most you'd realistically get if you took them to small claims court and won, and this way takes a lot less effort.

Did you sign an arbitration clause at closing? That's pretty normal these days. They make you think it's to protect both parties but it really is just for the dealership. I'm no lawyer but if you did, you can't do anything but take it to arbitration.

"Because arbitration takes away the parties’ right to a jury trial, discovery, and appeal, it must be agreed upon by both parties. Therefore, both parties must initial the arbitration provision before it can be enforced. Normally, any disputes arising out of the purchase agreement will be resolved by binding arbitration. If only one party initials the arbitration clause, it is not binding on the other party. However, if both parties initial the arbitration clause, they must submit any dispute arising out of the purchase agreement to arbitration. If either party brings an action in state court despite initialing the arbitration clause, the other party may bring a motion to compel the dispute to be resolved in arbitration. Without a compelling reason, the court has little power to maintain the action in its courtroom and must compel the parties to arbitration absent participation in the court proceeding other than to compel arbitration."

You should remain calm and relax. I know, my wife tells me this ALL the time. It will work out since you have it in writing and their admittance.

    1. There is probably some fine print lawyerese stating not responsible for errors.
    2. They refund your money and cancel the extended warranty (probably not what you want)
    3. Offer some refund. I would say very little and let them come up with a $$ refund. If you say $1000/6 years they may have been willing to go $500. The more you say, the worse it can be.
    4. If you don't trust them now, don't accept the we'll give you free oil changes for life kind of thing.
    5. Get everything in writing, read carefully. Don't accept anything until you know exactly what "it" is. Accepting "it" (whatever it is) may remove their obligation and your acceptance of resolution. (judge judy watcher)

Again we have one side of the story. Actually more like a third of one side of the story, since the claim is that he has a contract, but at the same time says they won't give him a contract. It seems he's got something in writing, probably a sales agreement. It should be adequate for nullification of the extended warranty.

The first place I would start would be to actually read everything that was signed. It's a very common practice for a dealer to let buyers assume they are purchasing an extended factory warranty when in fact they are selling them a third party warranty. Using words like Platinum Warranty that the buyer assumes means Toyota Platinum Warranty.

If it is anything other than a Toyota warranty, cancel it and get the bulk of your money back (minus $50 processing blah blah blah) If there's no trust now, it will not improve when you actually need the warranty.

My policy is to never buy extended warranties. I'm sure someday that something expensive is going to fail and when it does, I figure I'm about $20,000 ahead from not buying extra warranties.

If they’re not willing to make you whole or come to a conclusion that makes you happy you should take it to social media. A few years ago I had an issue with Lazyboy, long story short 6 months after I paid in full upfront for a sectional I never got my couch and they tried to deliver one the wrong color at one point. Anyways, I started posting all over social media daily and tagging that specific store and Lazyboy corporate. It only took a few days of this for corporate to contact me and make it right.
The good thing here is that the dealership you bought it from is in the wrong and you have proof. Most dealerships run on either word of mouth or return customers, if you can get the word out that that wronged you that can seriously hurt that specific dealership and that’s not something they want.
Someone mentioned going to the local news and have them do a story on it, another great idea. Anything to get the word out to as many people as possible and they’ll make it right.

Get a refund and move on. Extended warranties are generally a suckers bet(especially on a Toyota). Also OP youre way too angry and unhinged over 1700 dollars. Maybe you need more hugs or drugs. I prefer to mix them

The real question is do you see yourself keeping this truck when it has nearly 144k?

I'd just throw the money spent on the warranty and meme stocks and hope for the best. I mean people are claiming AMC will hit $100k despite selling more stock share last qtr vs. movie tickets

I bought an FJ Cruiser in a private sale. The previous owner had purchased that Platinum warranty from Toyota. The warranty transferred to me when I bought it. Right before I sold the FJ, I called the 800 number on the paperwork and cancelled the warranty. The warranty would only transfer one time, and that was to me. They cancelled the warranty and sent me a check for almost $1000. I would try to call and cancel the warranty first. Hopefully they will do it and send most of your money back. If you get back close to what you paid, consider it a learning event and move on.

I would think toyota could yank their service franchise if they won't honor the contract.

Everyone makes mistakes and I don't think you will win in court . I would tell them refund the money and they will comeback with a offer because they definitely want to keep the $1695.00 and then decide money or offer .

Call Judge Judy and tell the dealer your going to put them on TV. Or your local new station might have a team that loves doing investigations like this and exposing this type of behavior.

They made a mistake. Are they not offering to refund you any money? Did you pay for a warranty and now they aren't giving any type of warranty and not refunding your money?

Sit down with them and understand that people, even who have worked there for years can get things mixed up. If they don't wanna fix it and make it right or refund your money, then maybe you can go back with your pitch fork...but see what they offer you first before you go bat shit crazy.
