    First to address my pet peeve - you slammed on your brakes, not breaks. ;)Second, the other driver would have been at fault. Due to the location, which seems to be whollly on private property, you would have needed to take numerous pictures of the scene, as the area would have been relegated to a pissing match between yours and his insurance companies. Credit your being cautios (driving slowly and observing what this moron was up to) to keeping you from ending up with a broken truck.

    thats not entirely true

    on the SC form for a collision (TR310) there is a box under each Unit to circle yes or no to contributing

    Many officers (myself shortly) are certified to investigate collisions...im going back in June and August for Advanced at-scene collision investigation and reconstruction...



    OP...typically the other driver would have been found at fault, but regardless of who has the "right-of-way" you should always drive with due care to avoid being involved in a collision (be a defensive driver)

    Having the right of way will not keep you out of the hospital or downtime without a vehicle

    I'd much rather yield my right of way to avoid being in a collision over being "right" and being involved in a collision

    Not saying that you aren't qualified- but police never assign blame. Any time your write a ticket, investigate a collision, or do anything else...You are documenting what happened and maybe putting in opinions.

    It's up to an adjuster, arbitrator, judge, or jury to make the decision about how the blame (and payments) will be broken up.

    FYI: There are security camera's in that lot, so if there had been an accident there would have been some nice video evidence available. :)
