    Irony, The one who once protected our country (the one who got paid to protect it with his life), returns to that country only to be imprisoned by a system that gives a known criminal, rights.

    So let me get this straight, our government wants us to protect its interests, but we are not allowed to protect ours? We are in a very sad predicament. Don't you agree?


    I feel as though our government doesn't practice what it preaches?

    1 head shot probably got the job done. 5 additional shots from another weapon was probably too much. There is an in between that the good Light Colonel missed. Does it amount to murder-Not really sure.

    Once the threat is neutralized you CAN NOT go back and finish him off. Period! thats murder. Its called self defense for a reason, he was no longer a threat.

    dam. the extra gun and additional shots got him put away. the DA must have thought he had slam dunk case to try him. I wouldn't have been able to convict him if on the jury.

    OK, did a bit more research and a good friend willing to have a friendly debate.

    There was only one 'brandishing' a gun, and he got away. The problem was when Jerome walked back into the store, walking over the body and past a phone to grab another loaded gun, then walked back to the body, again passing the phone, only to take 5 more shots. This act moved beyond self defense.

    Now 1st degree murder might be a bit harsh. Man-slaughter might be more appropriate.



    I must recant my previous posts and lean towards, Guilty.

    However, my argument brings to question the law itself. Mainly, if an attacker threatens the life of another, then that attacker has lost all rights to the consequences imposed upon him at the time of the act. That is, the victim ought to have the right to do what he thinks is right. To be judge and jury.

    I do realize the cons of this argument; namely, police brutality, But let us not forget, there are considerable pros with this idea too. Namely, more people would feel comfortable wielding a gun and/or, protecting themselves. Which ultimately leads to fewer people willing to rob or burglarize knowing this law exists

    If anything, I think what he did was sadistic.

    As a retired Air Force Lieutenant Colonel, his training should have told him to double tap and select the next target. It's unfortunate he apparently let his anger take over. The worst I could have agreed to would have been justifiable homicide. Had he done it right, he would be a free man. Now, the Gov. needs to pardon him.

    the first shot was self defense, but when he came back and finished with the additional rounds...that was an execution.

    If a person is moving, that doesnt make them a threat. If he was trying to aim a gun, even if the would be robber was incoherant from the gun shot to the head, a few remaining shots would have been justified.

    by allowing "victims" to be the judge and jury you completely negate the entire basis of the judicial system, and by and large the whole "innocent until proven guilty by a jury of your peers" thing

    i think what you'd have on your hands may be fewer burglaries and armed robberies, but a exponential jump in assaults and homicides

    The legal system in place FOR THE MOST part is pretty clear in that you can use the same, or 1 level of force above an attacker to STOP the threat

    If you go above and beyond that, then you are committing a criminal act as well

    it's the second guy that came in (the one w/o a gun) that got shot, that is why there's a case in the first place, i believe... I would have done the same thing the pharmacist did (maybe not the 5 more rounds though), it's a bummer he didnt get the second one (the one with the gun) but i bet he's feeling pretty shitty for getting his friend killed.

    also if the guy would have gotten his ski mask on correctly so his eye holes were lined up, he may have seen that there is a gun pointed at him sooner!
