Wrecked girlfriends car. Im not on her insurance... now what?

    Like I said before "full coverage" doesn't actually mean anything. You need to find out why they are denying coverage, if in fact that's what they are doing. Without the reason for the denial, there's nothing but speculation and conjecture, which won't help anyone and will only confuse things further.

    Another possibility is that they may be telling her that your insurance is primary in this case, and hers is excess, which means you'd have to file a claim with your insurance company. In turn, your insurance company would also need to determine if they (your insurance) are primary or excess per the terms of your policy language. If both policies say the other is excess, then by default they are each responsible for their pro-rata share of the damages. In this case, it would be 50% each since this is a 1st party claim. If one policy says it's excess and the other does not, then the one that does not provides primary coverage for the loss.

    A buddy of mine got the run around from them years ago. I have a strict policy that I do not have insurance with a place unless they have an agent that I can meet and a local location I can burn down.

    I did as well. Screw progressive.

    Been with USAA for the past 10 years after that. I had a 200k dollar claim last year and they didn't even bat an eye.

    I have been with State Farm for years. We like our agent but I need to get a quote from USAA. The other accounts and dealing with them we have had have been A+.

    USAA is amazing and they REALLY know how to take care of their customers. I used to work for Allstate back in the day and if you had 3 claims in 1 year you were dropped like a hot potato even if it was just pure bad luck or someone else's fault. USAA is not the cheapest out there but at least they understand customer service.

    My father-in-law had two hail damage claims settled and repaired before most in his neighborhood even got their first check from the first incident.

    Can't say enough good things about USAA.

    USAA is the cheapest for us. We check every year and nobody else can meet their price.

    We don't even know for certain that they are denying coverage. o_O Refusing to talk to the insurance company and hiring an attorney is going to cost them money. What they need before doing anything else is an explanation in writing of what is going on.

    Now, if they really are denying coverage AND their choice to do so is incorrect, then by all means that have a claim for bad faith. That's why insurers are not quick to deny coverage. The Department of Insurance (or whatever name variation they use in a given state) gets nasty if an insurer denies coverage when coverage actually applies. Also, any ambiguous or unclear policy language MUST be interpreted in favor of the insured.

    Generally you can loan your car to someone, and they will be covered under the car owners insurance. However, if you and your girlfriend live together, you need to be specifically added to the insurance. The Ins company will assume that since you live together you may be much more than a casual user of the vehicle.

    She has Aspire insurance Co
    My insurance is Orion indemnity.

    A friend we know that works for an insurance company said this doesn't sound right they should cover it. She's been in car insurance for 20 years. She's going to help us

    Hopefully they make it right, those small companies can be a pain to deal with. Their goal is to keep their costs as low as possible by not paying out

    Doesn't sounds like it's going very well. Just buy your gf a new car. You say you can't afford it, but Toyota has 96 month and 120 month financing now so your payments can stay low.

    Well, what's the value of the Honda in its current condition? Any chance you could trade and buy something else? Might be cheaper than dealing with an attorney.

    I think the insurance company is giving you the run around though. They don't want to pay.

    That reminds me, I need to shop around for a better rate.

    Just quoting so maybe OP will read this 16 times, and maybe eventually it'll click... Making this way harder than it has to be. Take a deep breath, get in the same room as your GF, call her insurance, and hear their explanation. If they're actually denying the claim, there's a very concrete reason why, and they'll be absolutely more than happy to tell you about it. If/when that happens, repeat the process with your insurance. If/when they give you the same denial story, put your boots on and go work some overtime. Its literally that simple.
