Wrecked girlfriends car. Im not on her insurance... now what?

    You're probably right and this is completely different:

    I had my Black '99 Tacoma parked at a buddies house and we took his truck to go mountain biking. When we got back to his place his German Shepherd wanted to go so bad that he scratched up almost every panel on my truck. Guess he thought we were inside or just payback. Truck needed a complete paint job. His homeowners paid for the damage.

    I’ve had great luck with both. USAA covered a bunch of home damage/vandalism from an evicted renter and Progressive paid out quick and easy when a girl t-boned me on my motorcycle and totaled it.

    @Jerry311SD stop screwing around with websites, lawyers and crying girlfriends and get the actual copies of both your insurance. It will state in clear terms who and what is covered and under what conditions. Don’t bother calling the insurance companies back until you’ve done that and can speak clearly on the matter of why or why not they are refusing coverage.

    Never even heard of these companies.

    I will say this, cheap insurance isn't good and good insurance isn't cheap. (No shit right?)

    I could sit here half the night talking about some of our claims. One was for 580k (vehicle accident) and I talked about the one from last year above.

    Living in CA wasn't bad for me. When I moved to CO it tripled. I about shit a chicken.

    Now we have a bunch of people moving in that sold their shitbox homes for 2.5M and built homes and buy Ferrari's and McLarens. See them all over the place. We also keep a healthy umbrella policy too in the event someone smashes into one of those.

    There's a lot of well-intended but inaccurate/incomplete/potentially irrelevant advice here.

    There's also some really dumb shit that will only make things worse.

    OP, please just find out what they actually said. Are they denying coverage? If so, get the letter, post it here with all identifying info redacted. Are they saying something else? Ask them to email an explanation to your GF, post it here with all identifying info redacted. I am sure that I or someone else with experience on this topic can help you.

    Probably because it wasn't a big payout (assuming here, but correct me if I'm wrong). Ours was. In fact they screwed up so bad they offered to give us free legal representation. I had them also pay for our other attorney and they had no problem with it (they knew we could have came back on them).

    Definitely could be the case. It wasn’t a huge payout, about $65k between the bike and medical costs. Probably also helped that it was obvious who was at fault with witnesses and police reports.

    That's not a car accident. His homeowners paid for the damage because his dog did it to your truck. If you'd parked your truck at his house and his wife ran into your truck with her car, his car insurance would've paid for it.

    The lack of property/bodily damage would be a reason for her liability and/or medical coverage to not be applicable. For her policy to cover the damage to her car in a single-vehicle incident should be either under collision or comprehensive coverage (whoever her financing is through should require her to carry coverage that would apply here since their requirement is based on protecting the lender, not on protecting her or you). I'm 90%+ sure that auto insurance in CA is required to "follow the car" with the only requirement for other drivers to be added if they live at the same address.

    If her policy won't cover it through collision/comprehensive then the liability coverage from your insurance should apply if you're driving (this might be why her company is denying the claim, to force you to file the claim rather than them go to court with your company).

    At-fault isn't something that would be in question when there's only one driver involved, even if you happened to hit another car (I peeled the rear bumper off a parked car once trying to squeeze my tacoma into a too-small spot, and they still had an "investigation" even though I admitted to being at fault from jump); if you have a dashcam showing that something ran in front of you and forced a swerve, you might be able to get a no-fault claim but if it's just a skid/hydroplane then you're likely to be found to have been driving "too fast for the conditions".

    So she will call her insurance tomorrow and ask for her policy book so I can look it over and see where we stand. Her insurance card doesn't say much. I want to see if there's anything in there about me using her car and have EVERYTHING together before we call for the last time.

    That’s a start. While you’re on the phone you should have her increase her policy limits. Those are really, really low and any decent accident will exhaust those amounts and be paid out of pocket.
