Wrecked girlfriends car. Im not on her insurance... now what?

    Read the policy. ALL the policy. If it doesn't SPECIFICALLY state any other drivers that are authorized [or if stolen] are not covered, they are likely fudging. At that point see if she can contact the state insurance commish. They often love to break off axle shafts in lousy insurance companies. If need be, have her take the policy in to be looked at by a lawyer versed in insurance law.

    Looks like her policy does have coverage for collision and comprehensive (with a $1k deductable)

    I'm not an insurance lawyer, but I'd think that the stated limits for liability/injury for "drivers not listed" shouldn't also mean that collision coverage doesn't apply (which is maybe how whoever you spoke to initially read that to mean). Regardless of that, the liability coverage on your insurance should cover the damage if her company completely refuses.

    If she's with Geico, I've had issues with them in the past trying to refuse to pay for things which they told me were explicitly covered when I got the policy (at around double the premiums I'd been paying before them)

    I am no insurance expert. However, with at least some vehicle insurance carriers I have personally used in the past, they would cover a driver that was operating the vehicle at the time even if they were not specifically listed on the policy, but as long as they were authorized (by the policy holder) to be driving at the time of the incident. I can't say this is true in your case, but it is worth asking about.

    What would they tell the department of insurance? He doesn't even know what the insurance company actually said/told his gf yet. Talk to insurance co, get a straight answer, then check policy as it relates to that answer, and if the answer doesn't match what's in the policy, go to department of insurance and make a specific complaint. And don't spend any $$ on a lawyer at all at this point.

    A disbarred lawyer slammed into my wife’s JGC, he was driving his daughter’s Sequoia at the time.

    His daughter had Geico insurance, we’re not really sure what kind of insurance he had because he was from out of state and had a long and complicated bullshit lawyer explanation as to why he can’t provide any other form of insurance besides his daughter’s insurance card.

    Geico didn’t seem to be too concerned with who was driving the truck just that it was insured and his daughter’s insurance took a huge hit, because my wife’s Jeep was almost completely totaled.

    This was in California, were OP appears to be in right now.

    edit: I am not an expert on California insurance law, but my understanding and what was told to us at the time of the accident is that the insurance follows the car and the only way to get out of paying for an accident caused by somebody else driving your car is if you can prove that they were operating the vehicle without your permission…

    edit 2: I own multiple vehicles and have had the situation where out of state relatives have driven vehicles owned by me in California and have asked this question in passing to my insurance company and they always say that anything that happens while they are driving my vehicles will typically default to MY California insurance. To my understanding, there is no need to designate somebody as an operator of a vehicle unless there is a discrepancy between who is primarily using it and whose name appears on the loan/title.

    down to Shelter Valley to my buddies place for a day or target shooting, 2-3 times a year I get to camp out there in my RV with my neighborhood guys. We call it "Man Camp"

    i’m not sure what “no pd and no bi “ means? your insurance provider could extend your coverages to non owned vehicles you’re driving.

    op - i stopped reading on page 2 due to all of the false and misleading statements.

    her company has a legal right to refuse coverage it appears, but the reason is not evident. this is a permissive use situation but there must be some reason why this scenario is not covered by her policy contract. not knowing any of the parties involved, there also may be reasons discovered during the claims investigation (false statements, misrepresentation, etc). there can be many reasons how a policy contract can be voided, too many to go over here.

    fighting this decision probably won’t be productive. i would check with your provider and see if your coverages would extend to this accident.

    Insurance is weird, you can’t both be on the same policy unless married
    Or at least that’s what two companies told me, in different states

    there’s more that goes into your scenario. it could depend on where the people live and where the vehicles are located. usually companies will have a “one household per policy” rule.

    Can you speak to the OPs situation on getting a singular policy?
    Assuming they own their vehicles independently, which also causes issues I believe. Something along the lines of you can’t insure a vehicle you dont have an interest in

    there’s going to be some type of interest in the vehicle you want to insure - you’re the owner, you drive it, you’re financing it, etc.
