Yea it's BS but apparently they have to go in front of a judge and get the current paperwork overturned then resign the paperwork with the exact same terms but with the correct VIN and straighten out the registration, Toyota financial, and extended warranty.

Some stuff. Not a lot, just some.
That's why you need the judge. He has to void one legal contract before they can make a new contract.

So I hope you are going to get a bunch of free stuff for this F-up. I would start making a list and tell the dealer to start ordering it for you...

Hope you got something in writing to show that they messed up and are in the process of getting it straightened out. Word of mouth wouldn't cut it.

Hope they get this all resolved without any issues.

I would suggest getting a notarized letter of affidavit to carry around with your registration and insurance from the Toyota dealership your purchased at. If the other truck gets stolen, all the guy will have is his paperwork telling him the VIN, you will be SOL if you get pulled over.

You should also check to make sure that the correct VIN is reporting on your insurance. Insurance will use any excuse not to pay out. There are so many bad things that can happen in this situation you need to have all your bases covered.

    1. You need a letter or affidavit stating exactly what happened, and what is being done to correct it.
    2. You don't want to be driving around in a car without correct registration information.
    3. You need to make sure your insurance paperwork is correct.
    4. You don't want to be accused of any type of fraud in case something should happen between now and the time the issue gets corrected.

Since this is going to happen in court, there will be a complete public record with your name associated with it.

I don't understand why it would have to go in front of a judge, unless the guy that has the other VIN on his paperwork is a complete asshole. All parties should be able to sit down with a mediator or notary. Sign all the proper forms releasing interest in the VIN Number under the condition that the new contracts will be made with all of the exact same information except for the correction in the VIN number. Also get it in writing that you will not be liable for any and all issues associated with this clerical error.

Do not give the dealership a release of liability for any of this! if something weird were to happen 5 years from now, do you want to pay the legal fees?

    Edit to ad disclaimer :

I am not a lawyer, I am just thinking what I would do if I were in this situation. If they try to push you into anything at all, you stop the entire process and obtain legal representation.

After they resolve this, you feel that you still haven't had the satisfaction that you deserve there is a site that ALL dealerships use including my dealership. You can leave an honest review of their place of business and rate them to your own likings.

When I bought my 98, the dealership accidentally gave me the wrong license plates... I found out the plates they gave me for also for another Tacoma (different color), but I (and someone else) drove around for over a year with the wrong plates on... I noticed it when I registered my vehicle the next year (the paperwork didn't match my plates). Anything could have happened during that time that could have put either one of us in an awkward position. I am glad it worked out OK. I am sure that it happens all of the time without people noticing...

Sorry for ranting OP, it just reminded me of my situation. Good luck getting it sorted out.

OP, how about suggesting they void your contract and write up a new contract on the same optioned 2012 truck that is not assigned to anyone else and start over? Since this is the dealership's clusterfuck that is hangin your ass out in the wind, they should lose to make it right...as in you start over with brand new same option same config 2012 with the exact same terms that they had you sign up for in error. They won't learn from their mistake unless it costs THEM time and money.

You know everybody makes mistakes. If the dealer fixes this without any major impost on you I'd say just move on and let it go...

I'm thinking more along these lines, if I can get them to just fix this issue and maybe get them to pay for my registration this time around, I'll be satisfied. I did stop by my insurance agent on the way back from the dealership and update my VIN with them so that now they have the correct one. One step at a time.

I agree with this too, but cover your bases. As soon as you ask for something for free because of this, they are going to throw in a release of liability to sign. If they offer anything without release of liability, that is good will.
