But now, the lawyer says that i was correct in my overall assertion of fault in that instance, & you're saying that i’m not correct. Which is it? Would the guy be toast or not due to the data of swerving 7000 times prior to this particular accident? I would think not because the past driving history has nothing to do with that accident.

Read it again from the beginning. My wording was far from precise, but the essence of what I was saying remains. Past driving history alone can not determine fault in a specific incident... My apologies for the confusion and lack of legal terminology.

 

No worries! Now that I fully understand what you were trying to say, you are correct, a history cannot be the sole evidenciary item. Showing past behavior is not enough to verify current accusations. That said, a history of activity which coincides with witness statements about the event helps a LOT.

Yes, if they were swerving up to the moment of impact, SOME data would likely be allowed. That is provided it could be reasonably extracted without altering the format of the data as a whole.

Yes, absolutely. More so by insurance companies in an attempt to prove an accident wasn’t as severe as the Plaintiff states than to prove anyone was particularly at fault for an accident.

That being said, @Scrovak is still incorrect. Historical driving data is never getting into evidence (or shouldn’t or the prejudiced party has a great appeal). My driving data for 8/17 is never getting into evidence for an accident that occurred on 8/18 for example.
