    My wording was indeed inaccurate, but my point was that the guy would not be toast. That was all. But now, the lawyer says that i was correct in my overall assertion of fault in that instance, & you're saying that i’m not correct. Which is it? Would the guy be toast or not due to the data of swerving 7000 times prior to this particular accident? I would think not because the past driving history has nothing to do with that accident.

    Anyone who says "Oh, well everyone has a phone and your phone is always tracking you" completely misses the point. Phones can be put in airplane mode or shut off at anytime if desired. Those who don't care if they're being tracked are very much uninformed. For all others, there are options as stated before, simply opt out and do NOT set up connected services at time of purchase AND use the SOS button to disable that functionality.

    It was my understanding he was asking about all of the data, so if that data shows that an individual was swerving and driving recklessly right up to the time of the accident, that would absolutely be allowed

    Read it again from the beginning. My wording was far from precise, but the essence of what I was saying remains. Past driving history alone can not determine fault in a specific incident... My apologies for the confusion and lack of legal terminology.

    No worries! Now that I fully understand what you were trying to say, you are correct, a history cannot be the sole evidenciary item. Showing past behavior is not enough to verify current accusations. That said, a history of activity which coincides with witness statements about the event helps a LOT.

    Yes, if they were swerving up to the moment of impact, SOME data would likely be allowed. That is provided it could be reasonably extracted without altering the format of the data as a whole.

    I’m not sure if you have ever seen a Toyota ECU readout but I have a case going right now that involves a 4Runner. I’ll see if I can get permission to post some screenshots of the data.

    Yes, absolutely. More so by insurance companies in an attempt to prove an accident wasn’t as severe as the Plaintiff states than to prove anyone was particularly at fault for an accident.

    That being said, @Scrovak is still incorrect. Historical driving data is never getting into evidence (or shouldn’t or the prejudiced party has a great appeal). My driving data for 8/17 is never getting into evidence for an accident that occurred on 8/18 for example.

    It's lyrics from a "song" by Lil Dicky called "Pillow Talk". I HIGHLY recommend giving it a listen if you want some laughs. Its a ridiculous rap but its actually very intelligent if you listen to the lyrics.
