New York FFL used rifle purchase

    A question for anyone who knows the current laws for a FFL in Suffolk County NY.

    I went into my local FFL shopping around, they had just taken in a barely used rifle that had originally been purchased from them by one of their usual customers.
    Their customer is changing it for another rifle, this one he found too heavy for hunting but would suit me nice for my collection and for the bench shooting I am getting into.

    After agreeing that I like it and the price and that I rather take this nice used deal over the new one on the shelf, I was told they must wait a 21 day hold period while the rifle is checked in some system for theft and or ect. At this time I left a deposit, I was told they can not do my nics at this time until the wait period is over for them/me and they are free to sell the rifle. This will be the second rifle I purchase from this FFL. They are my local shop, I am NY resident with Ny license and my previous two purchases have been smooth sailing and came home with me the same day.

    1) I can not find anything online telling me this info, confirming what the FFL told me.

    2) I recently purchased a used rifle from a private seller, we did the transfer in NY and I drove home the same day with the rifle. That FFL actually "sold" me the rifle, because they want to avoid transfers and so that they can charge an extra buck. So that being the case why would this FFL have avoided this 21 day hold check ect.

    3) In all purchases I obviously have to go through the legal process of my nics, as well I have no issues waiting if I have no choice, but who wants to wait if you do not have to!

    There is no current wait period by law, it's usually 10-20 mins for the NICS check. There's no other way to check someone's criminal background. FFL's are granted access to enough national crime data to do their job properly without needing a wait period.

    Sounds like the dealer is scared of something. I've not heard of that. You should throw that up on LongIslandFirearms and see what people say.

    I will also ask on LIF, I was hesitating since I assume they also are on there, but I really should not be worried as I am the one looking to spend my money not the other way around.

    I think it is weird though, I purchased there in the past and went home same day with my purchase after the proceed on my nics. In this case they didn't even run a nics check yet on my, he simply mentioned he must wait by law since they just took this in as used, albeit from one of their loyal customers who had purchased this rifle in question from them originally. He said after his waiting period, then he could run my nics check and assuming its proceed I am good to go.

    The 21 day wait is probably squirreled away in a pawn law somewhere

    In South Carolina, a pawn shop or store dealing in used guns must hold any such items taken in for 30 days before they can be resold

    Same thing here. I sold one through an FFL and they had to submit the serial number into LE and wait 10 days for a hold response before they were able to put it up.

    The waiting period is normal for a used gun taken in by a pawn shop, FFL or gun shop. Wait it out and you can soon enjoy your new gun.
