    Let me get this straight. Arizona has a law that all drivers must have liability insurance. However, that law says they are legal with coverage for only $15,000 per vehicle. What kind of fucking law is that?

    File suit.

    Arizona requires that every motor vehicle operated on roadways be covered by one of the statutory forms of financial responsibility, more commonly called liability insurance, through a company that is authorized to do business in Arizona. This requirement also includes golf carts, motorcycles and mopeds.

    Minimum levels of financial responsibility are
    • $15,000 bodily-injury liability for one person and $30,000 for two or more people.
    • $10,000 property-damage liability.
    While AZ is low, so are most other States

    I would contact a lawyer. If their insurance will not cover the damage to your truck it will be your insurance that will pick up the difference. Neither their insurance or your insurance is going to have your best interest in mind. I wouldn't sign or agree to anything until after talking to legal representation.

    I'd be pretty close to this right now. I would not accept a bum offer from any insurance company. Your insurance company should be handling getting the party at fault to make things right. I don't see how things can be made right by waiting until October for a frame.

    There are Lawyers all over that would eat this kinda thing up. I am pretty sure their consultations are free to let you know where you stand at least have some peace of mind.

    Yeah been there too, years ago some freaking guy didn't want to wait 5 minutes on the drive thru lane so decided to put reverse and hit me bad, front right bumper, fender and headlight got smashed, to make it short, the damage was around 2k, I took the car to the Honda collision center and kept all paperwork, took pics of how my car was before the repair, knowing I will receive BS on the time of sale that car.
    Well when time came for a new car every dealer was giving me crap saying that pops up on Carfax and they didn't know the extent of the damage even if I showed pics of the damage, they didn't care, so trade in that car was not an option.
    Can't imagine what OP will get if the Carfax says frame damage.

    Fl insurance sucks as well, I still have a lien Florida Statute 55.081 against a guy in Fl from 8 years ago that hit me with State Minimum Insurance and he does everything he can to show no fucking money and has tried to hide his assets, but I am getting close to getting my 10K real soon as I have discovered he and 5 family members inherited some property from a Parent and now that got a lien and they can't sell it and I told the Family,Mortgage Real Estate company and the trust Attorney to fuck off pay me my money and hung up the phone. Nothing can be done with the property until the lien is removed by me and it's not happening anytime soon. I did tell them 25K would be a starting point for resolution...

    Big Daddy and Karma is in the drivers seat now motherfucker I told him I would get my money 8 years ago he laughed.....

    Now that I saw some posts before my last reply, UNFORTUNATLY I think you need to get a lawyer involved. They will probably look into suing the person who was responsible vs getting into insurance companies business.

    Sucks, but what someone above said is correct. If you go to trade it in down the road, you will get crap for trade value. Probably about 60-70% of actual trade value. You will be stuck for a while, and since you are worried about Gap insurance, my thought is that you will have a long road before you have any positive trade value in that truck.

    While this information is interesting, all it means is how much THEIR insurance owes THEM.
    It is important to keep an understanding of who is responsible for what. Fact is that THEIR insurance company doesn't owe you ANYTHING.

    Think of it like this;
    They crash you, causing you financial or bodily harm.
    You sue them, judge awards you, say $35000.
    THEY owe you $35000.
    They happen to have a contract with an insurance company, that says if they get into a crash, insurance company is willing to reimburse *them* up to a maximum of $X.
    If $X is less than $35000 owed, that doesn't mean that the other driver doesn't owe you the full amount. It just means that they need to cough up the difference on their own.

    Now the reason why a certain amount of insurance is mandated, is just in case THEY have no assets or income with which to repay you the damage that they've caused. It means that you'll get your $10,000, which is enough for you to buy a used car so that you can still drive to work and otherwise live your life.

    If the offenders aren't able to cough up the money, and you don't have an insurance policy that will cover the difference in this case, then that is the risk you take by turning onto the road and driving.

    Now even IF your insurance policy covers the difference, that still doesn't mean that the offender doesn't pay it up. It means that your insurance company will hand you the money, and then SUE them or apply other mechanisms to obtain that money, like wage garnishment.


    Now speaking as someone living in a jurisdiction that requires something stupid like a million dollars of liability coverage, I *WISH* that our minimums were sensible like in AZ. Means that instead of paying idiotic premiums like $1000-$3000 per year and never getting anything out of it, it would be sensible to establish insurance companies to which you could LOAN, say $40,000 to (minimum required payout). They could invest that money, and the investment income would more than cover administrative expenses, and *still* return something to you. And if you crash your car at your fault, it comes off the loan, continued coverage just requires that the balance of the loan exceed the minimum required coverage. Retire from driving? Refund the loan. Now of course I'm sure that nobody has been smart enough to come up with that idea. I mean imagine an insurance policy that actually PAYS you?

    It doesn't matter what specifically they were doing.
    Only two things matter;
    1) They crashed.
    2) Whether or not any mechanical failure contributed to the crash.

    It makes no difference if they were playing with a phone, or spilled a coffee on their lap, or reacting to a kid in the back seat who just threw boogers at the other kid in the back seat.
