Low Transmission fluid Lawsuit

    I need everyone who has had their transmission oil levels checked and adjusted to send a pdf of the work order to the provided email. Tag everyone who is relevant to this. The more people the better.

    You can not blur your name or info, if this goes to trial, YOU MAY BE called to witness. 95% chance not, but they may request a written desposition or something like that.

    DO NOT SEND IN FRAUDULANT CLAIMS!!! That will only make things harder.

    The 2nd gen guys with broken leaf springs didn't complain this much...good luck suing Toyota.

    So your advice is to bend over?

    I'm not suing Toyota. I'm trying to amass a decent amount of evidence to present to my lawyer cousin whos firm specializes in insurance. It's the first step. but its a much better step than saying "fuk it, I can't do anything about it"

    if we get 100 work orders showing low transmission fluid I think thats something that a firm would look into.

    A recall would be a big deal. Getting Toyota to extend warranties on 2000 trucks is barely a thorn in their side.

    You're going to sue on a basis of speculation that it could have possibly shortened the life of the transmission, but have no evidence of excessive wear or any failures or any number of failures below what Toyota considers "life of the vehicle?"

    You would have been better off leaving the fluid low and letting them take a shit. Otherwise, toyota, unless I'm wrong, has done everything they are required to do to fix the issue up to this point.

    I'm not a lawyer though, but it doesn't really make sense.

    Probably good advice. I see where you are coming from, but even IF something happens...each owner would get a check for $20 in the mail.

    Yeah, I'd send that info to a legal firm, but sending my name and "full info" to a random TW account and accompanying email address? I don't think so.

    $20 isn't worth all this bs, if you want to help you'd be better off making a post telling people to check their fluid and fill it to where it needs to be, nobody's going to send all their info for this

    Exactly, best you'll get is a $20 bill to wipe your tears with if it really does cause premature failure down the road.

    1- You signed paperwork when you bought the truck that you won't participate in a class action suit.
    2- your not the first person or the last to try and go down this route
    3- good luck proving anything.
    I feel for you brother but it's not worth it. Either lemon law it, sell it or live with it. Either way you'll have a better life. As sad as it is that's advice you can bank on...but what would I know ( wink )

    OK, I believe you guys. Still think theres something wrong with sending trucks out with 1.5 quarts low, and that would legitimately deserve an extended warranty.

    What do you guys think is the best way to go about it? Many dealers won't even check the fluid level and give the runaround.

    Here's my advice...
    Take it in an ask to speak with the service manager directly. POLITELY tell him about your dissatisfaction and ask him to check your level. Pay for it if you have to.
    If they find it low then they will take care of the bill 100% and you'll have more ammo to politely explain your problem to a case manager. If it's full then that's 150 bucks that makes you sleep better at night. Should you have to go through this? NO but that's the situation, deal with it as necessary
    Yo can't go in like this and expect results...

    I agree with you. But starting a papertrail is never bad. I've never had mine checked and don't intend to..but if my tranny goes out right outside of my warranty I and others will have something of value to point to and say, hey, they knew about this! if we don't start now, nothing will ever happen. I'm not claiming we will win or all be awarded $5 but at least we can let Toyotas lawyers know that we are smarter than they give us credit for.

    There's no downside to starting data acquisition. The guy who said he won't send info to a random gmail is right. That was dumb of me to think ppl would do that. You can send it to our lawyer directly, e-sign confidentiality etc. but I want at least 20 ppl before I ask her to open a file for us.

    I think a better approach is get it documented at the dealer and open a case with Toyota corporate if yours is low and voice your concern. Then it is on file. Start this process if people start to see mass failures right outside of the warranty period. But I highly doubt if it was documented, like I suggested, that Toyota would deny fixing a transmission right outside of warranty, especially if many were to start failing. Their brand is built around reliability and if they lose that they are done.
