    Front end is messed up too. and i agree in a backyard with a welder and junkyard parts 800 dollars. But at a dealership pulling a bed. Replacing the rear of the frame, bumper,tow package,trailer hitch hookup and wiring is easly a 3500 repair. Not counting the front end.. then the current and future damage risk to the transmission,u joints,steering rack. Dealer wont even inspect the tranny. They will just replace it. I was told that at the dealer. Then on top of all this theres them having to pay me losses for knocking down the value of my vehicle. Then the risk they get thousands into the repair and another problem is found or im not satisfied with the repair. Also consider they could settle with me and run this through an auction here and get prob 10k for it as is and it will be repaired inhouse and on a buy here pay here lot 2 weeks later for 20k.. i know this all too well. Ive been in the car business.. im not sweating it.. even if they fix it im gonna milk the 75 percent for all its worth and get a good bit for loss of value and pay the truck way down... ajd im gonna make the dealership so aware of my pickyness that they prob wont even work on it. And if they say the trans is good they are gonna put it in writing.

    No way they would replace a section of a frame, that's what frame machines are for.

    It cost me 450 to have my rear frame straightened after my collision about a month ago.

    Well lets say they dont replace a section of the frame. The frame is bent because the tow package that attaches to the frame with the hitch sticking out twisted the frame. When it hit a rock solid object at 20 mph downhill with no brakes. The tow package didnt give. The frame did. Had the hitch not been in... i would totally agree with you.. Lso if they try to straighten it that would be a weak point from now on and id never trust it to tow at intended capacity. Now if it were a paid for older vehicle id just have the frame reinforced with steel plates and boxed in for a couple hundred bucks at a welder. But thats not gonna happen with this truck at any legit shop.

    I'm going to have to side with the OP on this one, why in hell should he accept anything less than what he had before the dumbass smashed his truck! We pay craploads for insurance and then get screwed when we need it! I'd sue the hell out of her for gross stupidity!

    Well, his insurance company is only going to pay out for the policy he bought. He could have bought a "full replacement value / over book" policy, but I doubt he did, friendly agents to the contrary.

    Most times, if you want to try to recover what you feel are all your losses, instead of those losses you contracted to cover, you need to follow with your second point - sue the person who did it. However, if it's outside the bounds of small claims, it's rarely worth it once you factor in the cost for the lawyer.

    Well lets be real.. it will go to auction and be fixed and back on the road within 2 months. Its not like im taking it to landfill. My point is i bought a cremepuff with no issues. Ive gotta pay for this truck for 5 years at 350 a month plus 100 insurance. If i dont feel good about the truck im not gonna wanna pay that payment. I didnt wreck the truck. Had i wrecked it i could see the logic of "i get what i get" even though at 100 a month i should get whateber i want but... its Nationwide's claim. I have allstate.

    Im gonna know what they are gonna do before i let anyone take truck. If they are gonna fix im gonna demand an exact figure of depreciation. If its not atleast the full 75 percent going to me. Im gonna refuse and use my resources to get it totaled or get my 75 percent. It will happen. The insurance company is getting off super easy. My truck could have killed kids in the culdesac that were playing,could have missed the mailbox and went further down the hill and either went through the front of a house or totaled a new quad cab tundra that was sitting there. Plus the woman that hit me didnt have any notable damage to her Tahoe due to the tow package being built into the bumper. They could be paying out 50k plus or millions if a kid got killed.

    This is a liability claim against the at-fault parties insurance, so what he carries for himself is actually irrelevent. He could go after brand new OEM replacements, doesn't mean he will get it however. That insurance will want to keep claim as low as possible.

    Lol, if I'm reading it right, I'm curious how He self determined the huge huge depreciation costs. It'd be impossible to find a rebuilt truck at 25% of the value

    75 percent value in claim before totaling. 75 percent of my 22k baseline(and ill prpb get more) is 16,500. So if i allow it to be fixed thats the settlement ill be after. If i get it fixed for 6500. 10k goes to me.. for depreciation and to "buy out" my rights to a transmission. I just met with the adjuster/estimator Looking like a total to me.
