Seems like there would be gouge mark in the road as well from the residual wheel dragging.

The wheels appear to be this model from Gear--it does not strike me as an especially rugged wheel...

Wear your seat belt. Your arm against the roof didn't save you, unless you are able to press 2-3 x your own weight with your arm. That's the kind of force that throws you from your vehicle. You just got lucky and your doors stay closed. I don't understand people who don't buckle up. It isn't a hassle. It isn't uncomfortable for anyone over 5' 2". The vehicle shuts up when you buckle up. There is no tough guy benefit. It teaches others who look up to you good habits that could save their life. Not sure what that leaves. It does impinge on your personal freedom to be an idiot.

FYI: wheel separation accident investigations have proven that front wheel-off incidents DO NOT result in loss of control. Rear wheel separations can result in rollovers, but fronts don't.

There was/is a single gouge in the median where it shows a deep rut in the grass all the way across.

I'd talk to a lawyer, but I wouldn't get my hopes up. Proving by a preponderance of evidence is going to be a stretch here. It'd be really hard to prove it came off pre crash. Even if you managed to, the damages are relatively small since you didn't suffer any significant injury (thankfully). Any injury you did receive it could be argued that it was caused by you not wearing a seatbelt.

In summary you are looking at a stretch of a case to recover 15-20k in property damage. Unless you pay up front I don't think any lawyer would take it.

Looking at those pictures, there is a lot of missing spoke between what is left on the rim and what is left on the truck. Find them and video yourself finding them. If they are strewn between where you lost control and where you ended that is a good indication it went out while driving. If they are more bunched up along where you rolled it probably came apart during the roll.

As far as lawsuit, you also have to look at the age of the wheels. You will have to be able to prove the wheels were not damaged prior. Unfortunately, you are probably SOL as far as that goes. Hopefully you had full coverage.

Interesting reading on black boxes clear back in '07. Things have changed a lot since then. I think now days, anyone can buy the software and cables to download info. Still a legality issue on being able to download someone elses data though. As mentioned in this thread, it can prove your innocence or prove your guilt.

I saw a wheel that looked like that once. A 16 year old kid driving an S-10 Blazer too fast on a rural back road. He ran off the road, over corrected and started rolling. Police guess about 3 times. When the wheel came in contact with the pavement on the 1st roll it broke just like that. The driver was wearing no seat belt and was ejected, the car rolled over him, DOA. The 3 other passengers were wearing belts and were released to their parents with only minor injuries.

I'm a retired teacher and taught all 4 kids, including the driver as well as the parents of 2 of the 4. I was 1st on the scene and got blocked in by emergency vehicles and couldn't leave for a while.

The question here is did the wheel break and cause the accident. Or did the accident break the wheel. I'm no expert, but I'm thinking option #2 is more likely.

another question... were you on the cell phone when the accident happened? Were you reading a text when the accident happened? The police can subpoena your cell phone records, but in an accident like this, they probably wouldn't because there were no other cars involved, no injuries or deaths, and no significant property damage from the looks of it. However, insurance companies can and do subpoena cell phone records also, especially in injury cases - some companies are more likely to want to take a look than others, and sometimes the amount of damages can cause them to do this. Probably not likely in this case, but it's something to think about. Distracted driving has become a very big deal lately.

this is also a good reminder to check the torque of the lug nuts on our trucks... especially if you just had any service done that caused wheel removal.

It's funny you say that , well not funny but I have a story . A few years ago my neighbor comes banging on my door and says you might want to go down and check on your car , another car had a accident . So I get shoes on and run down stairs to find out a Ford Explorer was turning the corner by my apartment building and it LOST THE TIRE . My car was was parked directly on the corner and the tire rolled past my car hitting the side of my apartment building . The explorer fell to its brake rotor about 3 feet from my car , the tire was next to my car . My car was luckily not hit by anything , the lady driving the explorer told me she just left the shop and had a brake job done .
