    It is for real, and you are an eligible class member, however you have 12 years from the original date of service-or-one year from the final approval date (May 21, 2017) to have it inspected and qualified for frame replacement. So far Toyota has "dicked away" a month of that¹. If I were you I'd be on the phone with the class counsel and Toyota just about every day 'til I became such a PITA that they'd do something just to shut me up...

    ¹ - The court however has retained jurisdiction over the settlement; so if Toyota screws around too long they could be found in contempt of the order and subject to redefinition of the settlement terms:

    So I am looking for a used Tacoma and want to make sure that I don't get "taken". If I buy one that's between 2005 & 2010 in the very near future that has not had its frame replaced, is it eligible for the frame replacement if it needs it? I'm in ny. If I am, how long is it eligible for? There are so many different opinions and scenarios that I don't know what to believe. Thanks for the info in advance.

    No--you must have owned it on or before 12/2/2016 to be a class member...

    As I have mentioned in prior posts this pretty much destroys the current value of '05 through '10 Tacomas with rust damaged frames. If I were looking at one that was not too bad I'd use it as a lever to get the price WAY down...

    Best advice is dont buy those model year Tacomas from anywhere in the "Rust Belt" https://en.wikipedia.org/wiki/Rust_Belt

    Basically if I could do it over again, I would not buy one from the North East. Best bet is down south or out west. Or if you want a 2nd Gen, buy a 2012+ model, but even those can show bad signs of rust if it lived its life in those areas. The majority of the 2nd Gen 2012+ models look like either a slightly different design or just better materials were used.

    I hate to be 'that guy' who just adds on to this thread, but I am confused about something. I have a 06 with a rusty frame. I spoke with my dealer to bring it in next week to look at the frame and leaf springs, and they told me I was only eligible for the leaf spring, and the frame thing 'expired' in March of last year.

    But reading this:

    "The Frame Inspection and Replacement Program will begin following the date of Final Order and Final Judgment is entered and will be calculated by the longer of twelve (12) years from the date of the Subject Vehicle’s First Use, which is the date that the Subject Vehicle was originally sold or leased, or, if the Class Member has owned or leased the vehicle beyond twelve (12) years from date of First Use, one (1) year from the date of entry of the Final Order and Final Judgment. "

    I should still be covered though, as the Final Order and Final Judgment was issues on May 21 of this year, correct? I have owned the truck for about 3.5 years, the wording makes it sound like I would have needed to be the original owner? Doesn't make much sense.

    briangig... I was at a toyota dealer a few days ago. I was told to check back in 30 days and that they hopefully will have the procedures from toyota available.

    does your frame have holes near the catalytic converters?Also check the frame side rails where the metal is sandwiched together.

    I just checked the frame settlement website again this was just added.... "In June, 2017, appeals were filed to the settlement. This will delay implementation of the settlement." Heffler claims group just told me everything was dismissed, whats going on here.

    Did you speak with an attorney, or just someone that answered the phone? I ask because it might have been that the appeals were dismissed and whomever you spoke with was not clear re that. Dismissing the final Order would require hearings on the appeals and a judge's Order of Dismissal; something that would be unlikely to happen in just a couple days...

    That is called lamellar corrosion, it grows along grain boundaries, proceeding away from the site of initial entry, and within the structure of the metal. It is often exacerbated by poor process control during rolling at the time of manufacture. It is a cancer, and like cancer is often hidden until it is too late. Once metastasized it is unlikely to be arrested by application of any coating--removal (with possible replacement) is the only cure, but unfortunately one that can kill the patient.

    Exfoliation
    is a similar process but characterized by large flakes of rusted steel falling off layer by layer, when the corrosion occurs under just a surface layer and the expansion causes the corroded metal to fall off--layer by layer. It is kind of like psoriasis, regular topical treatments can keep it under control--it is not deadly but nothing cures it...

    I just picked up my truck at the dealership, had my steering shaft replaced because it was rusted to the point it was about to break off. My frame is full of holes and I asked them about the settlement. I was told they are just waiting to hear from Toyota but don't expect it to happen anytime soon, that it would be dragged out for awhile. He did tell me whatever parts I wanted to replace that they would put on with free labor, whenever the settlement does happen

    Hi All! I have a R-title 2007 Tacoma. It got the CRC coating 4 years back but now it has a hole in the frame.

    The R-Title came from being in an accident shortly after it was bought (3k) miles. It was all body damage - Nothing that would have affected the frame...

    The hole is where the front exhaust hanger used to attach to the frame.

    Wondering if I am part of the "Class"...? Not sure how to read this section.

    "Pursuant to the Frame Inspection and Replacement Program and the Inspection Protocol, Toyota shall offer an initial inspection of the Subject Vehicles and additional inspections, as necessary. Salvaged vehicles and vehicles with flood-damaged titles are not eligible for this benefit."

    Did Toyota apply the CRC, under the terms of the previous LSC-E0D service campaign? If so then you are excluded from the Brian Warner et al v. Toyota USA class--but I'd go for it anyway and let them make an issue of it--see how good their records are...

    ^^^This is in error, the "previously treated" exclusion is with regard "new" CRC being applied to previously treated trucks--see my posting below...

    @cliffyk yes they did - So any vehicle that was coated under the first terms is now excluded even if rust holes have since developed?
