Glad to hear you're ok but man that sucks. Hopefully it just means their insurance will pay for some upgrades for you! Same thing happened to me and I got a new steel bumper and winch with the money.

I also had a buddy tell me about resale depreciation due to the accident and the other person's insurance company paid out the depreciation value (even though I never plan on selling my truck)

Fuck man that sucks! The discussion of the wheel bearings wasn't even that long ago. Glad you are ok. Hopefully she'll get fixed and back on the rd. Don't let the ins. company try and swindle anything with this situation they are going to be in hot water. Also if you hurt just a bit tomorrow go get checked out just to be safe.

DISLIKE!!!! I'd consult a lawyer and if need be hire one if the ins. company wants to play hard ball. I've gotten recent repairs/improvements paid for by an ins. company as well as damaged aftermarket parts. You just have to play hard ball and not back down. Not in a threatening manner just mentioning consulting with a lawyer can get them to loosen up sometimes if they are playing hardball.

I've had my fair share of accidents and dealing with asshole ins. companies. But my experience is by no means all knowing of what a Lawyer knows as far as what you are entitled to for reimbursements and what the law allows. Also NC vs SC there could be some differences there too.

Do you want the bad news, or the really bad news?

Doc, "You've got 1 week to live"
Patient, "Wow, what could be worse than that?"
Doc, "I was supposed to call you last week"

Your truck is most likely totaled.

The other vehicles insurance may weasel out of paying for your truck since the driver didn't have a license.

So why get a lawyer? I have USAA and they seem pretty on point as of right now.

I do have a court date for the guy that had no license though as a witness

    All the things!
Be sure to get the insurance claim wrapped up before his insurance company finds out he wasn't driving legally. Non valid license usually means insurance won't cover the event. I know this, because I was hit on my motorcycle and the driver's license was suspended. That was in WA, and it could possibly vary state by state.

I'm in NY and I have a uninsured/underinsured clause on my policy. Costs me a few extra bucks and helps in situations like this where the other party doesn't have a license or insurance or insufficient insurance etc. For me its worth the few extra bucks per policy period.

Because sometimes it's best to have someone on your side this would be a good question to ask a lawyer consultations are usually free. I have been down the road of letting my ins company handle things and it usually takes forever and they are horrible at haggling because they don't see the value in a modified vehicle or the stuff you did to it.
