I am planning on giving my Taurus Judge to my daughter and her husband. Would this have any legal problems for me if he or she had to use it for protection?

Take this as worthless advice, since I'm not from West Virginia and just random guy at a keyboard... You may want to call a local gun store and see what they tell you for a private sale. A quick google search looks like you should be okay. WV guns laws seem pretty open with no permit needed to buy over the age of 21 for handguns. As long as they are in state, and over 21, you should be fine. You may want to complete a basic bill of sale just in case, but who knows how much that would protect you. This form has a section for gift versus sale.

Forgot to mention, she lives in Virginia. Don’t know if that would matter or not.

Shouldn't be a problem, so long as neither your daughter or her husband have any violent felonies to their names, to the best of your knowledge. :cookiemonster:

I agree with above, a quick call to a FFL/dealer should get you a more expert opinion.

Since it's across state lines the transfer has to be handled by an FFL on both sides, one to ship and one to receive, so they'll need to arrange a location of their choosing to pick up the firearm. Other than that they'll just need to do your typical 4473/NICS check and maybe pay a transfer fee and they're G2G.

Yeah I’m pretty sure handgun’s need to be transferred, otherwise you could be liable.

You'll want to go through your FFL, transfer the gun into their, one of them, names. If anything happens, bad, good, or otherwise, it's in their name not yours. Like if they lend it to someone, it get's stolen..... Transfer that gun.

Go by your state's rules. They are all different. Quick call to a gun shop or the local sheriff should answer your questions

And i am guessing you want it to be a surprise. Well you can get it done.
Since you all live in the same state it is quite simple.
Get your FFL to transfer all the details in her name.
make a bill of sale and make it know you are letting it go for $0 so you don't end up paying any tax.
She still needs to email her ID to your FFL though but that can be done later after she receives the gun.

They don’t live in the same state. He lives in WV and they live in Virginia. @p1smo has the correct answer.

My father gifted some guns to other family members before passing. These family members want these weapons off the books. Guess who still has these weapons?

On a recent trip to TN (and surrounding area) I found it ridiculous on what I had to do depending on what state we were in (handgun wise). Illinois was the worst. We just set two extra stops in the GPS. One before and one after since I had to unload the weapon and put it in a locked container for transport. We normally would have taken a different route, but diesel was close to 6.00 and it would have added a couple hours both ways. Shortest route won this time.

Interesting on how different states handle gun sales. Some no background checks, others it seems like you need a top secret security clearance.

Last time we went to TN I found I had to unload my pistol and put the ammo and mag in a separate place from the pistol

It's been 5+ years since we've been, they must have changed the law. I called and spoke to a trooper before we went

Maybe. It could be different state CCW reciprocity laws too. Looks like NC is good to go though. Then again we might not have been in compliance either.

We really liked NC. Beautiful state man. I forgot how green the south was.
