TBI Disability awarded; new claim for back issues?

    @Boyk1182 since you've got experience with this.

    Coming back to this thread before I go opening anything or claiming stuff.

    I've always had back issues (but not before enlisting), but over time they've only gotten worse.

    Never thought anything of it, but in a recent visit with my new doctor at the VA (I moved, so different VA hospital) suggested many of my back issues may be attributed to my service.

    I need to go in for an X-ray, though I just started a new job today but will try my best to make that visit for an X-ray. I experienced sciatica 2 years ago for the first time, and even with stretches, poses, and the use of a theracane (provided by the VA) my back pain is so bad it literally leaves me disabled. I'm in bed as I type this, unable to properly stand.

    They also called me back so I can schedule seeing a chiropractor.

    So, with the VA acknowledging and providing all these services, is it wise to think they are assuming it is service connected?

    I will add that I was not only a squad leader, but also our section radio operator (our other radio operator was KIA so I learned the MOS as secondary). One of the cons with having been section RO is that I had to carry a PRC-119 radio often as we didn't always have the PRC-148 available.

    For those that don't know, the PRC-119 is the radio often mounted in the humvee...not the skinny one either.

    I hiked with that a lot, and took it with us on long 4-6 hour dismounted patrols...could have attributed to my back issues you think?

    Even have a certificate of commendation acknowledging my position as RO and have pics of me carrying the damn thing if it counts.

    I do have health insurance as well and hoping to get a new doctor out here for a second opinion.

    Just wondering after all that, if this is something I should file a fully developed claim for?

    Been out since '09

    Came from the generation of "suck it up buttercup" and if you were bored enough to read the thread, you'll see I didn't bother with a claim for many years since I got out. Just kind of "dealt with it".

    I would file the claim, and write a statement about a page long explaining how you hurt your back in service. If they deny it, you’ll need to file a Supplemental Claim with a nexus letter. I can help if it comes to that.

    The reason I say to do it in this order is because if you give them a good nexus letter with the claim, there’s a chance they don’t even consider it. From what I see, they usually don’t at that stage, they just look at the C&P exam. Also, you need new and relevant evidence if you have to appeal, so if you gave them your nexus letter for the initial claim, you’ll need another one to appeal.

    I think a good statement from you, pictures, anything that you think would help, and this should be granted on the first try.

    I don’t want to give advice not to submit a nexus letter with an initial claim, because it should and could help. I just wanted to explain that if they ignore it, which is common, you’d need another one to appeal. Just wanted to clarify for anyone who reads this.
