    The asshole who hit my truck was over the legal limit and got a DUI; Not only that, he'd killed somebody while driving drunk back in the 1980s...

    His insurance company didn't give a shit; Sir Drinks-A-Lot, a 70-year old man from Florida, told his insurance company I ran a stop sign and that was all they needed to not pay me. Luckily, I had full coverage on my truck and my insurance company ate the cost of fixing it. In a bizarre turn of events, the drunk driver hired a lawyer who owned the bar where I worked at the time in an attempt to fight the DUI, and this same lawyer got me a nice little restitution that I used to buy dashcams and a backup camera for my truck.

    I'm not the sue-happy type, but given the looks of your truck, this is good advice. My 75 year old mother, would never sue anyone, thought it was bad form. Well this last summer she was hit by a city bus, and felt fine. My brother immediately picked her up, and took her to the ER. About 8 months later, her lawyer is still accumulating medical bills, and other expenses for the lawsuit. Even she'll admit, she's glad she listened.

    that's what I've been reading, that fighting for DV is a losing battle on its own. I'm hoping its considered totaled but I'm hesitant to put my faith in the adjuster saying that it is

    As long as the truck is fixed right, I wouldn't particularly care about diminished value because I'm the type of person who keeps vehicles for years put well over 100K miles on them.

    i went to the ER the night off and had some xrays done and such. i let my insurance know and they made it part of my claim as well

    Relatively low miles; They might not total it! If they do total it, just make sure you get enough to pay off the loan! Someone I know totaled a Subaru that he still owed money on and the insurance payout wasn't enough to pay off the car.

    im going to try and get the value i still owe on the loan. even if it wasnt totaled and insurance covered all cost to fix it, i will be trying to get a new truck very soon afterwards. i wouldnt feel right keeping it

    Well, the primary insurance is only going to pay what the truck value is, not the loan amount. Hopefully the OP has some equity in his truck.

    My grandma bought a brand new Hyundai Santa Fe in 2010, and the dealer tried to trick her into buying gap insurance that she didn't want; Luckily my uncle was with her and gave the salesman a piece of his mind...

    From what I've read, gap insurance is for people with no money who live paycheck to paycheck and/or people who buy from those shady "buy here pay here" lots...
