    The cop wasn't on the scene to actually see the circumstances so I'm just curious how can a cop give a ticket to someone for something he didn't actually witness himself. That's all seems like bull shit to me. Not only does he feel bad he hit someone but now he has to go to court for some ticket and pay a fine on top of insurance cost to get his truck fixed. This is one of the reasons I hate cali all they give a fuck about is money and not give a damn about our rights

    Easy. They write the ticket based on the evidence at the scene and the statements of the individuals involved.

    They do it all the time.

    If someone fights the ticket, the officer will submit his notes into evidence. If he is relying on the other party's statements that person will be subpoenaed to show up and testify.


    Umm... that's what happens when you follow too closely and end up rear-ending someone. Props to the OP for owning his mistake. A lot of people don't have the balls to do that and need to find ways to blame others.

    As for your desire to move, I'm unsure where you're going to move to, the same thing would happen in just about any state. Note the OP is not in California.

    We'll then I stand corrected I've never rear ended someone before didn't know they could issue tickets unless the driver was drunk or something. Never heard of people getting in an accident and getting a ticket that's like double fucked. Sorry for what happened OP and good luck with everything man just take this as a lesson to back off

    My wife was in an accident in her toyota solar years ago, she slowed down and stopped in traffic and the guy behind her not only didn't slow down, he was accelerating and smashed into her and drove her into the car in front of her. Both ends of her car were completely crumpled but her airbags never deployed!

    As for the above post, people get in accidents and then get cited all the time. I was driving down a busy 4 lane city road going about 20 mph and a woman traveling the opposite direction took a left turn directly in front of me with no warning. I smashed into her, destroyed the whole front end of her car and just damaged the front left panel and radiator of my tacoma. She was cited for failing to yield and had to pay my insurance as well as whatever the cost of her citation.

    That's like saying one can not be charged for murder if the police officer didn't see it. I would assume it's a traffic violation and he will need to send in the fine money.

    Yes, it does add insult to injury. Still, without tickets there're no points on licenses, and without points and the chance of losing one's license, there's not as much incentive for the bad drivers to shape up.

    You know it seems maybe your truck did a nose dive more then a straight impact. Maybe that why the air bags did not deploy.As your truck dived down it force was at a angle more then a straight impact. Seems that why your front bottom bumpers ripped out .Maybe?

    Hey OP, glad you're OK ... knees jammed up hurts like hella... yeah 30 mph can KILL someone easy. So OP glad you're ok..air bags should have deployed. I'd go that route... unsafe to drive! Seriously.

    On the ticket... I call bullshit on the cop. Declare innocent and go to court... heck the star witness even told the cop he didn't know why he hit the brakes??

    I bet I can guess why... he was on the phone with his boyfriend and they were having an argument, got pissed slammed on his brakes .. boom.

    Cops giving out tickets.. for an accident?? It was an ACCIDENT not a moving violation. What is a moving violation is talking on the phone while driving.. if not hands free. Subpoena phone records for court day..... could change EVERYTHING, just sayin. And ALWAYS go to court.... never plead guilty.

    doesn't matter at all that its california. Its like that pretty much everywhere.
    You don't need to witness it to see he is at fault and following too closely. If he hadn't been following too close he wouldn't have hit him.

    There was another thread on here where a guy had video of himself almost hitting someone and said it wasn't his fault that the guy stopped suddenly, video shows that. But it many said the same thing to him, including he was a special one and said something along the lines 'these trucks cant stop as quick so the distance wasn't enough' but somehow still considered had he made contact with the vehicle wouldn't have been at fault...when admitting he was not keeping a safe distance to allow him to stop.

    They have ways to calculate the speed and distances to figure out of someone was following too close. Other than like @gpb said, without video showing the guy didn't have brake lights or cut in front and slammed on the brakes, no court would say the OP isn't at fault for this and that he was following too close. We all do it at some point, but at least own up to it that you fucked up and are at fault for the accident.
    Only thing to do now is pay the insurance increase and smarten the fuck up next time and leave more space.

    only rear end collision I've seen as not at fault was for @perpetualenigma3 and that was because the guy he hit was drunk and pulled onto the street when he shouldn't have.

    you can get a ticket for following too close, even without being in an accident. I actually worked with a guy that got one and showed all of us it at lunch. Mind you he must have been the dumbest person on the face of the planet because the vehicle that he was written up for following to closely...was a cop. WHO in their right fuckin mind tailgates a cop on the highway? Had his work not already have shown how fuckin stupid he was I wouldn't have believed it.

    Could have seen something he though was coming in front of his car, could've had his foot slip or didn't realize how much force he was applying. Doesn't matter still was following too close and OP is at fault for accident.

    BUT the charge could add to insurance premiums even more since the accident so ya could be a good idea to fight the charge. But no way to fight the at fault for accident. Even if it was ruled as 50/50 still counts as an at fault claim on your insurance and it goes up, to the point mine used to be expensive as shit because of a hit and run on the highway sending me into a guard rail, but you know cop couldn't understand why I didn't get the guys plates. I mean who can get a guys plates while he clips your front end sending you into a guard rail at 60mph then takes off? Didn't even matter that there was white paint on my front right fender showing I was hit and a witness saying they saw I was hit. Insurance adjuster ruled it as 50/50 and it made my premiums go up for 7 years.

    One other situation is where you're pushed into the car ahead of you through no fault of your own. Happened to me at a light years ago. The guy who hit me in the back end got a couple tickets and his insurance paid for both ends of my car plus the car ahead of me. :)

    It was a lowered Acura TL Type-S that I hit.

    As far as the citation, that will likely be dismissed once the insurance is settled. The courts around here don't waste time on those. The cop even told me there is a 95% chance it gets dropped once a letter is mailed to me stating the claim has been settled by both parties.
