    Alright so 2 months ago a put in for a week long vacation that is pre scheduled through my wife's work... and I gr a job offer to own my own business that I can't pass up. So I came in Monday morning and put in my 3 weeks notice I'll work a week and have a weeks vacation then come back for my second working week of my notice? The owner/boss is mad saying he might not pay me for my vacation... is this legal? It should I just work the one week and roll out???

    Don't burn a bridge unless you have to. Tell him you are trying to do the right think and are sorry for the timing but this vacation has been scheduled. Get it in writing that he will pay your vacation out otherwise I would say you quit effective immediately. Try to work with him though if you can.

    Vacation is a wage benefit that may or may not be provided at the discretion of the employer. However, if the employer does promise vacation pay or vacation time off with pay, then the employer must have a written vacation policy which clearly explains how the vacation is earned and how it can be taken. Also, any earned vacation must be paid at termination unless the employer has a written forfeiture clause which clearly explains how the earned vacation can be taken away.

    Do you have a employee handbook that gives the ways vacation is paid or a written agreement?

    You have to be paid out for earned vacation. Not personal days. They can terminate you early if they want, but will still need to compensate you. If they fire you in lew of your notice, you will qualify for unemployment pay.

    depends on the states employment laws. But most places its your time, and if the vacation request has already been approved, I don't see how they can refuse, let alone take your earned vacation time away.

    lol.... it's a wage benefit and in some states you are not entitled. I know in my case I accrue vacation hrs by hrs work so for 80 hrs worked I get a total of 6 weeks by years end...

    It is up to the Employer and the State laws. They can say fuck you!

    My boss has to ok when and how long vacation is taken. That plan you just mentioned wouldn't fly where I work at. You either enjoy your vacation or enjoy your new job, not both! IMO :annoyed:

    I accrue hours based off time worked like IPNPLS, but I also have a payout if I were to leave for the remainder of my hours unless I chose to forefeit those hours. I think if you know your company operates similar then I think you might be backed by it. My company is big enough that they have to have policies like this or else they would get sued quick if they screwed someone over on vacation when it has a paper trail of being approved in a timely fashion.

    Good thing with my Company is we can bank 2 weeks every year for a total of 8 weeks and then cash out whats left over.....My Company stands behind it's employees for the hard work we do.

    It's a motorcycl shop that the guy was planning to close and I kinda fell into... it makes plenty of money he just got a sales rep job working for one of his vendors and really wanted to take it. It has been a very rushed process... I feel like I'm 5 years I've earned that vacation... I didn't want to leave them in a bind. But giving 3 weeks notice 2 of which I will be working I felt was fair!! My nrw shop will be closed for a week already bc the previous owner has to start his new job a week earlier than my 3 week notice. I'm just in a spot that I feel it's not right
