At least contact Toyota dealer about it and see what they say.

I can ask but I don't really see my demands carrying much weight. It's my responsibility as a buyer to look over the vehicle and I missed it. I'd love to get my money back but I don't know what grounds I'd have to demand it.

Also I could threaten a lawsuit but once again, I don't think I'd have much grounds plus I'd have to pay for that

Maybe it was already asked, but is the rest of the truck in good condition? If so, it may be worth the pursuit of the frame repair. I don't think you can get your money back from the seller. Whether he knew about it or not, all he has to claim is that he didn't.

It's in decent condition. Has some dents and dings.
My biggest concern would be how to be sure the rust is fully repaired. And I'd guess the cost would be pretty dang high to have it professionally repaired

Sorry for the spot your in.
Long shot but maybe contact Toyota cares or corporate. Seems the truck should have been flagged when it was found by the Toyota dealer in 2016. Maybe they will fix it now.
Here in VT they are not supposed to let it leave. I’d also contact the inspection shop here again they could lose their license or face some steep fines.
(As Is) is huge here if not mentioned Or issues the vehicle needs to pass Inspection needs to be disclosed.
You can hold seller responsible not sure how big the hassle is haven’t done it.
    Wish you the best!

but, but, but, I'm missing something here. A Toyota dealer found the hole during the time frame the campaign was ongoing but not replaced?

If it wasn't CRC treated they won't replace frames.

I'm wondering the same thing. Since this was documented in 2016, the frame should have been replaced. It seems worth a shot at least, especially if the rest of it is in good shape.

The campaign expired march 2016 and the vehicle was at toyota october 2016. If I had to guess, they saw it but told the guy "tough luck, you're too late"

Categorically not true. There was no requirement for a frame to have been CRC treated if it met the criteria for replacement. Mine had no CRC, and was replaced.

The dealer that did mine really didn’t care if it had the crc.
my dealer didn’t care about much of anything either.

the class action suit gave us 12yrs from in service date.

March 2016 is when the official factory recall ended. Subsequently, and totally separately, there was a class action lawsuit, the settlement of which required frame replacement if certain criteria were met. This is the '12 year window' people are talking about. I had my 2007 taco's frame replaced in 2018.

So it sounds like it was at the dealer after the factory recall but before the settlement. I would absolutely appeal to Toyota - this thing should have gotten a new frame. It still should. Good luck!

This guys got it right. Here's the official WEP settlement for '05-'10 Tacos.

    It is time relevant.
When a service campaign is announced, affected vehicles with holes were not treated the frames were replaced. Read the frame warranty campain letter(s) from Toyota.

Part of what people here are getting confused about is that the '11-'17 frame replacement program specifically states that if you don't get the frame CRC treated within the 1st 2 years of the program, you aren't eligible for a free frame replacement ever. This stipulation is only for the '11-'17 Tacos.

The CRC treatment clause is in the frame letters for 1st and 2nd gen Tacomas.
