Thanks for clarifying this! I was so preoccupied with my own frame drama that I didn't really look into what the deal was for later models.

When I say frame drama... So I received notification from Toyota that the frame warranty on my 2007 Taco was being extended until Spring 2016, and that I qualified for a new frame. I read the expiration date as May instead of March (eyes not very good with fine print). So April comes around, and I sez to myself, "self, let's don't wait until the last minute, let's get 'er done now". I gather up the paperwork to look it over, and there it is: MARCH 22, not May. I MISSED IT!

Boy did I kick myself around some for that screw up! I think I might have frightened the dogs with my, um, outburst of colorful language. Then, somehow I heard about a potential class action suit. This is when I joined TW. Long story short, the settlement came down, I qualified, and got a new frame. Which was probably more than I deserved for being such a bonehead!

I sincerely hope that you (OP) are able to make it work out!

I don't know about 1st gens, but nowhere in the '05-'10 settlement does it say you had to have had the CRC treatment done in order to qualify for a free frame replacement. It states conditions where you do qualify for a free CRC treatment, if a frame replacement is not necessary.

That makes two of us! I'm trying to figure out what my course of actions should even be. I guess I'll go to some dealerships tomorrow and plead my case

I'm talking about the letters sent to owners, you're talking about the settlement announcement letter.
You got it right when you said " I don't know"

So if I read this right, the extension gave people 2 more years from the time of the settlement (in 2017) if they were in cold weather states (which I am not) so... I think back to square one

That's what I'd do in your place. Bring whatever paperwork you have, and just lay out the timeline to them, and hope for the best. You deserve a new frame!

The 2 year part refering to cold weather states is strictly about CRC treatment. The frame replacement part is the later of 1 year from date of the settlement or 12 years from date of 1st use. Toyota is not legally obligated to replace your frame, since it's past that time. However, since it's documented that they found a hole in 2016, it seems like they're moraly obligated to replace your frame. That's strictly up to Toyota though. I wish you luck.

Exactly - the hole was documented in 2016. I think Toyota might do the right thing here, if the case is made clearly.

I hope you're right but I'm still not sure they were obligated to replace it when it was in 10/2016. I'm probably missing something so I apologize

They were not obligated to replace it - at that time. Once the frame settlement came down, they were. And since a nasty, qualifying hole was found and documented at a dealer sooner than 12 years after in service date, I think you have a strong case. Don't give up!

Still. Give it a shot. Based on the information you provided. Reach out to Toyota directly. Worst they can say is no, nothing we can do for you. Like they did to me a few years ago. At this point, you have nothing to lose...

I guess it doesn't seem like Toyota is obligated to help me and was wondering if I was missing something but I'll just call them tomorrow and see what they say

I could be wrong but I think 05-08 were different than 09-11? I have a 10 and you had to get the first inspection where it either fails as is or passes AND must be coated to be further covered before anything else

I posted a link to the official settlement notice that was mailed to a ‘05-‘10 TW member. Interpret it however you want.

I bought my truck from a dealer and they reiterated many times it is sold "As is" and Lemon Laws do not apply to it. Mine is an 05 an I bought it about a month ago. It was a Chevy dealer (No idea who traded a 1 owner, dealer serviced, 05 Taco with 76k miles for a Chevy.....) if that matters though
