You'd be wrong. Insurance might pay out similar to your guess. But I'd go as high as 98% plus is rider's fault.

Someone else braking the law doesn't absolve you of fault. Just legal liability. If you zip through a green light with your head down and someone runs the light. YOUR fault. If the intersection is blind and someone does it. YOUR fault. You should have slowed, knowing you couldn't see. etc etc ...

Other than random animal jumping in front of you and getting rear ended at an intersection, and someone intentionally gunning for you, I can't think of a situation that isn't avoidable through proper riding technique, and I don't mean swerving and stopping. I mean observation, speed and distance.

AND Loud pipes make drivers angry. You can't hear them coming, (contrary to some "people's" opinions) so you're just startling people and making them resent riders. Not to mention your neighbors might start throwing soap in front of your driveway.

I get sick of the frikkin lame ass "that dick crashed into me"... car, bike, pedestrian. Look out for your G$D DAMNED self.

The trick is keeping your head in the game 100% of the time. That's why I keep taking the refresher or new riding courses. Just puts it back to the front of your mind. Keeps complacency at bay. And there are some great courses out there.

Sport rider's course, I could take or leave. Was fine, but I'm not looking to go fast. But it does give confidence should you enter a turn too fast for your normal style that you can push on that low peg and go farther. MSF basic, not worth it more than once (lot of classroom and training wheels stuff) but they do an abbreviated experienced rider version. Just a day of the same exercises plus a few.

If you can find someplace that does the advanced or police/professional rider course. That's good. They surmount things and lock both brakes etc.

If you've never tried this .. you're missing out. OR this

I don't like using cones. Only time I've ever dropped my bike (on pavement) was doing a slalom which I kept shortening and shortening till I hit a cone doing about 3 and it stopped the bike cold in a lean. Too heavy to hold up, I had to let it down. Now I use half tennis balls.

    :brianr: haha

good point, just riding defensively, yet aggressive enough to stay away from trouble, and i should be just fine!

Agreed. With that in mind, watch this video again:

The driver of the van changed lanes without yielding to approaching traffic. BUT, the rider made two errors that also resulted in the crash. One, he was riding too fast while splitting lanes. Two, he should have seen that van had its turn signal on and seen it start to change lanes. The rider didn't appear to slow down or even react to the van until after impact. Completely oblivious? That is a dangerous way to ride.

i love my bike. i got an 07gsxr600 and i live in socal where no one knows how to drive! but you can be as cautious as you want but just realize other people are not as careful so you always got to be ready. be in right gear, scan everything and its always nice to predict what may happen. you can never be too safe on the streets. splitting lanes is always fun at a good speed though.. but ive seen some people out there that go a bit fast for me.. just dont drive like an ass and youll be cool! "burn rubber not your soul" lol

This was 150% avoidable and 1000% the motorcycle riders fault. He was going too fast while lane splitting and not paying attention. He's an IDIOT!

and this is one of the reason why there are so many bike crashes in SOCAL... if you are doing this then you are just asking to go down.

wait.. so the van in the carpool lane crossing the solid yellow lines had the right away? think you need to take another driving test. im not sure if you ride but when splitting lanes we try to pay attention to everything. riding a motorcycle is dangerous theres no doubt about it so i myself pay attention. you cant do anything about the van swerving in your way at the last second. the person in the van trying to get out of the carpool lane illegaly should pay more attention. please correct me if im wrong but im sure that wasnt legal. splitting lanes isnt illegal either. its a gray area of the law. plus he wasnt going fast at all. i found that to be a nice speed to do that. it gives the drivers enough time to see a bike coming in your sideviews. ive seen some people that just blast thru the lanes. but anywho im not trying to start an online argument but just share the road. :proposetoast:

I think the point that was trying to be made was that it seemed like the rider wasn't paying that much attention and it didn't look like he tried to avoid the van by slowing down or swerving.... honking.. anything. At the speed he was going he might have ended up hitting the SUV on the right if he had tried to swerve IMO.
Not disagreeing with you that what the van did was illegal but that is beside the point. No one else is going to look out for you and by the looks of it the rider acted as if he expected the van pulling out to see him and stop, which it obviously didn't.
BUT on the flip side maybe it wasn't that fast, it's hard to say since we weren't there. Maybe the camera lens distorts things and we are not getting a true depiction of how it happen.
I know when I watched it the first thing I thought was "damn slow down a little" then I expected the rider to hit the brakes as soon as I saw the van, which it didn't seem like he did. Then I expected him to swerve, again, nothing.
But that's just my opinion, I might have reacted the same in that situation, just saying what I thought when I watched the video.

damn can I babble on and on or what?
:proposetoast: right back at ya bud.

lol. true.. we really dont know how fast they were going but it didnt look bad IMO. ive seen worse. but who knows like you said we werent there. and ya us watching it i wouldve tried to swerve or stop. but then again put yourself in that situation who knows how fast it really happened. it looks like there were other bikes following so you couldnt slam on your brakes or maybe he did think hed beable to squeeze by but the van pulled out a little more and blocked him in the last second. who knows.. some people just dont know how to drive sometimes regardless it be in a car or a bike.. lol but ive noticed here on our electronic freeway signs it reads "watch for motorcycles. share the road" (something like that) but its nice to have that to remind people there are motorcycles out.. anywho another virtual beer toast back at you! :proposetoast: lol

I've watched it a few more times now... ok more like 20 BUT I think maybe the camera being mounted on top of his helmet gives a different perspective and we are not seeing what the rider saw. That couple of inches would make a huge difference. A little lower and maybe we wouldn't see the van till the last second either.
So maybe I am a complete douchebucket!
Wouldn't be the first time! :D

I thought they killed off lane splitting in california back in the 90s.
