    My friend got pulled over when he was 16 with a huge ass pinch in, and like 4 cans of dip in his truck and he told me the cop said 16

    yeah I know its a bad habit and was just a side note but I don't see the problem with enjoying a cigar every once in a while.

    My point was that I didn't get searched with all that stuff in the truck that could have been considered probable cause. Not to mention teenagers normally have more problems with some officers than other people do.

    I know people that have done it since they were 13 and haven't had any trouble but I think it is illegal under 17. But maybe your buddys right

    Sorry.........not true. PC is PC. If you don't have it, you don't have it. No ifs ands or buts about it. If you get pulled over for a ticket, take your ticket and be on your way.

    Movements and acting nervous are not PC. They may be used as indicators that you are doing something wrong so they can continue digging, but it is not PC.

    PC is actual "proof", for lack of a better word, that a crime has been committed. It can not be made up. It has to be something that the officer sees, smells, touches that is in violation of law.

    A search and a frisk for weapons are two very different things.

    If the cop smells or sees drugs, then it is a search with PC. If a cop believes that there may be a weapon in the vehicle, then they may perform a "Terry frisk" of the vehicle and occupants (in search of weapons). This Frisk is limited to areas of the vehicle easily accessible and within reach of the occupants where a firearm may be located. Locked compartments do not count because they are not easily accessible.

    Remember.........you can give consent, but just as you can give it, you can revoke it unless something incriminating has been found. You can also limit the areas that the officer may search. You must make it clear though what areas may and may not be searched. You do not have to give them a reason why either. Remember, he is ASKING you if he can search.

    When the officer asks for consent, you are in control of the search. You determine when the search is done and what areas they can search.........That's why it's called consent. That is, unless they find something that gives them PC. Then they can tear your stuff apart. :cool::cool::cool::cool::cool:

    You are wrong about PC- The definition of PC is "Based on the totality of the circumstances, a reasonable belief that a person has committed a crime"

    So if you are stopped for any number of moving violations...and you act twitchy and keep sniffing and rubbing your nose while I stand and talk to you, with a nervous aire about you...I might believe that you do cocaine...and reasonably...I can infer it's possible you have cocaine in the car....and from that I can explain PC to a judge and jsutify the search.

    It is not definite proof of anything- If it was definite proof it would fall under "plain view" doctrine which surpasses the requirements to meet the PC test.

    You are right about searches. Most folks don't know that you can limit them like that.

    "a reasonable amount of suspicion, supported by circumstances sufficiently strong to justify a prudent and cautious person's belief that certain facts are probably true"

    if a driver (or pedestrian for that matter) is in a high drug/crime area and commits a traffic violation unrelated (speeding etc) and i walk up to the vehicle and the driver is acting more whacked out/nervous than a reasonable person would be and i see him attempting to move a bunch of stuff around in the vehicle like he's hiding something or even fails to give me his proper name

    that right there is enough reason to search a car

    its all about being able to articulate how these actions etc directly indicate the probable violations of law

    again...its not 1 specific action or just acting 1 way or another...its totality of the circumstances
