    You might want to seek counsel just for some general advice on how to handle this. Want to make sure you get taken care of. You don't want to wait very long before you do because of statutes.

    Asshole who hit you was driving a BMW... son of a bitch can't be that broke.

    Everyone please contact your insurance company and make sure your policy covers you for underinsured/uninsured motorists. Not all states have general policies that will cover you, you have to open up additional coverage for it (and they don't tell you at the time you open a policy).

    For you people who drive around without insurance... there is a special place in hell reserved just for you.

    I have contacted a family friend who is a personal injury attorney, and unfortunately there is not much to do. Not worth my time going to small claims court for a few grand. The individual who hit me seems like a "fly by night" type of character, and will prob never end up paying anyways.

    It is a pretty shitty situation, and I just want to move on now. I will keep this thread alive though with any new updates.

    I used to sell cars, and you are absolutely correct. If someone rolled in with a 3 year old bmw, no one wanted to wait on them. The trade appraisal would piss them off, big time.

    I’d take him to court regardless. These types of people will just continue to do this until someone gets serious with them. Take them to court, if they don’t pay have their wages garnished.

    Eh, after having been through this, if he is anything like The guy I dealt with (not a car accident) I would disagree and wouldn’t spend the time and money moving further again. These guys can have wages garnished if they don’t report income. I spent thousands, the guy never showed up to court, so I have a judgement against him awarding me money I haven’t seen one dime of. He has judgements against him from other people including bigger players like banks. He moves often, doesn’t have anything registered in his name including his car which is always different, his credit score is terrible. He obviously seems to have a way of getting cash he doesn’t report and spends immediately, my guess is dealing drugs.
    These guys have it all figured out on how to evade these things. In the end these scumbags know the game better than us law abiding citizens, it is disgusting but sometimes you have to just walk away. The civil court system can’t help, the best you can hope for is him to be charged criminally.

    Unfortunately, this is an example of why uninsured/underinsured motorist coverage exists. In some states it’s mandatory unless specifically waived by a policyholder. OP, I’m glad you were able to settle your collision claim. Be sure to get a medical evaluation regarding your back pain even if you didn’t seek medical attention on the date of loss. Take care.

    Juts stumbled upon this...Hope you are feeling better OP.

    One of my biggest fears driving is that someone hits me and has no insurance. I recently had my 2016 totaled, but luckily the person had insurance, and was found 100% liable for the accident.

    Happened to me in TX. I sued the guys mom for letting him drive a car under her name. Fck garnished wages, I put a lean on his new car under his moms name and ended up owning it.

    He got another one under his girlfriend's name and I was awarded that too.

    He was 24 hours away from getting a GTA for not showing up to court and turning over the car when I got a settlement offer.

    Paid for my FJ supercharger.
