Dealership forgot to put in oil at 6000km

    Holy cow are you guys overreacting! Chances are the truck is perfectly fine! A few fairly basic tests could prove that. Should the dealer offer up more than a free oil change? Absolutely. But demanding a new engine after driving maybe 2 kilometers with nothing but residual oil in the engine without any testing is jumping the gun quite a bit. I would be pissed as hell if it were me but the reality is until the engine is checked out NONE of you know if there is actually any damage. I suspect there isn't given my experience. People make mistakes every day. Yes it sucks, yes I would be upset if I were the OP. But suing over everything that upsets you is exactly what is wrong with this society and a big part of why everything is so expensive. If we had 1/4 of the lawyers on the planet we have now it would still be too many. Granted there are real situations where they are needed. This isn't one of them.

    Wow Thanks guys for all the comments. I'm going to wait to see what they offer me before I go to a lawyer. I couldn't stop when the oil light came on I was on an overpass at the time. I also got them to put it on the toyota record what happened.

    I think canada should have there own forum...this whole canada law is this US law is that...no they dont do it up here no they do it down here laws is confusing...:D Sorry OP personally I wouldnt have taken it off the lot...if i take the responsibility to change your oil and didnt put oil in it you would want me to pay for damages or take me to small claims...the dealer is no different...thats why they operate under LLC...:)

    Have you ever read court logs from colonial times? Have you ANY idea how often people sued each other? and for such seemingly trivial things!

    It's really funny! I was reading some old township court transcripts and saw one suit where a limb fell across a fence and let some chickens out...they sued and the settlement was the plaintiff got the next several months worth of chicks and eggs from the guy who's limb fell until he could replace his lost stock. I supposed that was in lieu of giving him his stock of chickens which would leave the defendant without.

    Do you suppose that was worth the equivalent of $6,000 today?

    It's in our blood to have selfish disagreements...lawsuits were intended to provide a way to settle them. The problem is when you have to bring leaching lawyers into the issue.

    Still, a lot better than the alternatives..."does she weigh as much as a duck?"

    Chances are it is perfectly fine but that's not the problem now. If it was a plane would you take it up in the air? It was a brand new truck getting broke in. It's broken in now. It sure as hell not new now. There is no way in hell I would have taken it back after that.

    Here a letter will solve this. It will never get any farther than that. We don't do your guys trick up here suing people.

    This truck will eventually screw up and chances are sooner then later than if it did not happen. Compensation is in order.

    What else floats in water? But can you imagine how much better off we would be if people didn't sue one another over everything?

    I think if you found out one thing it is that there is a lot of disagreement over what should be expected. It would be good to know some facts before trying to evaluate their offer: what have others gotten in similar situations?

    I know of a couple similar cases in the US...one at a Jiffy Lube and one at a Walmart. In both it went exactly like I said: they got a guarantee from the company to make good on any future repairs. That leads me to think that's the standard down here unless the engine shows obvious damage at the time of the occurrence, like it or not.

    BUT...you have a special case in that 1) you DID drive it back after you noticed the light; in both of those they never left the parking lot. You COULD have pulled over and gotten a tow. Unfortunate, but there it is. And 2) going in it was a freakin' brand new truck, now it ain't. How do you get that back?

    At any rate, I know I'd be looking for some advice from people who've seen this kind of situation and knows what the standard for resolution is. Toyota could be your friend here, I hope they are.

    That would only happen if they don't make it right. I think they will make it right up here. They really don't have a hope in hell of winning if it ever went that far. We usually up here work things out long before it ever gets that far unlike you guys down there.

    If that happened to me I'd suspect they knocked the oil pressure sensor off or the sensor died for some reason. It would not even have occurred to me they forgot to put oil in considering that is why it was there in the first place. After all he just paid the bill for that work. Some places here you cannot stop for any circumstances what so ever. Bridges and over passes are common spots for those signs. It's just too dangerous to stop on them. If it is moving you cannot stop even in a accident you have to drive off. There is usually a pullout on the end of them for insurance paper swaps, fixing flats or what ever happens.

    Yes indeed...but isn't it interesting how people perk up and start to play ball when that letter from the lawyer is opened? The threat of a lawsuit gets their attention every time. Just like when dad came in...we stopped fighting. Every time.

    A smart lawyer knows just how far to push it and avoid going to court.

    Personally me I would not go there. I bought it to drive not sit in the shop getting fixed. Murphy's Law chances are it will break down in the most stupid place middle of nowhere and just when you need it the most. He is already in the middle of nowhere. Up here in the winter that could prove to be a fatal mistake. Where he is is where people freeze to death.

    WOW, this is a tough call.

    A great way to solve it would be a "maintenance bond" to 150,000 miles and somebody could probably write it for $2,000.00.

    OR ... a more possible solution below ....

    Have the dealer and Toyota Corp. put their money where their mouth is --> with a free "Toyota OEM Platinum 125,000 mile Warranty".

    Toyota Corp. gave me one, when my transmission blew at 500 miles on my new 2007 Tundra.

    125,000 wouldn't be enough. OP's plans were to take care of it 'forever' and this is a problem that WILL reduce engine life.

    Very true. I'll also say that stuff like this is exactly why I never let anyone work on my vehicles I don't know personally. Unless it's warranty work. Usually the guys doing the oil changes and tire rotations are the "junior" techs. Out of the 3 new tacoma's I've had only one of them ever went back to the dealer. And it was for a bad dome light switch when the truck was a week old. With the exception of 1/2 of my first wheel bearing job on my last 05 (I didn't have a press back then) everything is done in my home shop. I realize not everyone cares to work on their own stuff. I can't afford it any other way with 5 vehicles.
