    Insurance is required in Ohio but not everyone has it. The Bureau of Motor Vehicles does not check insurance so allot of people go without it. If your unlucky enough to get hit by someone without it you can sue, if you think they can pay. If not your screwed paying your deductible. It sux but at least I am ok. My neck back and shoulders hurt like hell but I am ok.

    Lots of time that uninsured motorist is too poor anyways, so suing them would be pointless. Or they are illegals who shouldn’t be in the country anyways, so they don’t care. They just keep running from the law.

    Lost my Chevy from a gal with Fake Insurance (got passed the police officer that showed up) so couldn't make a claim. My Dodge was stolen and wrecked by illegals (2 of the 13 in the truck were caught). Luckily, I had uninsured on both trucks. Chevy was totaled, took the full amount of money and they kept the truckl. Dodge was totaled, bought the truck back and took difference from the insurance and fixed it.

    Needless to say, I will always have uninsured motorist coverage. To your first point, that's what the insurance company told me when I asked if I or they could recoup. They said most uninsured motorist, even if you get judgement in your favor, will never pay anyway, so they wouldn't pursue anything.

    It depends on the state.

    In my state I have to carry a seperate insurance policy to cover uninsured or underinsured motorists. If I get hit by someone without adequate insurance or no insurance and I don’t have this additional policy I have to pay for all injuries and damage on my own.
    I could obtain a lawyer and attempt to sue the person but lets face it uninsured people are typically broke and have nothing to take and litigation could take years.

    Some states may cover you under a standard policy.

    And some states may require this policy if a drunk driver hits you. Drunk driving can be considered a strict liability (basically an intentional act) and their insurance could deny you compensation.

    Just out of curiousity how do they enforce autoinsurance in Canada? In the US you are required to have it too. Too bad the law does no good.

    Glad your ok, it sucks to have your truck looking like that!!!!

    In Illinois we are required to carry insurance, 500.00 fine for not carrying it or jail. Uninsured is usually in our insurance package to some degree.

    it's required.

    but nobody checks. some one will buy insurance and opt for the monthly payment. then they stop paying, but they have the paperwork to prove it if any law-man checks.

    if i ever become king of the world: no insurance, you dont get to play. for example, you drive around uninsured. someone hits YOU..and they have full coverage..you have to prove you have an active insurance policy covering you or you're screwed.

    The system in Canada is not the same in every province. In Quebec, where I live, there is an automatic no fault insurance with your annual registration renewal. You cannot get a car loan without proof of insurance. The system isn’t 100% effective but it works. If you get pulled over by the law and cannot prove you are insured it’s an automatic fine.

    Unfortunately there is not much of a deterrent for the uninsured motorist. Down here in TN i have seen the police let them drive off after hitting somebody with a ticket. They should have the car towed and. The uninsured motorist gets a trip to jail. Happened to my mom twice, to totaled cars and medical bills and not one penny from the uninsured motorist. So what if they pull there license they still will drive.

    Its the same here in the US. You are supposed to have insurance for a loan and to register your vehicle and you get fines/tickets for no insurance but a lot of people still don’t have insurance.

    All you haveto do is carry 1 month of insurance to register the car and buy it then you can cancel it.

    What states don’t require you to have insurance?!?

    All the states I have been to does (I’ve been to 20 of em), and i thought it was federal law to have auto insurance.

    TegoTaco; we are suppose to have auto insurance, but what people do is cancel them after the register/buy the vehicle. If you get caught by the cops without insurance, that is a ticket. If you hit someone and you don’t have insurance, you can get sued, but people who don’t insurance probably don’t have the money to pay for repairs, which is why we get uninsured motorists coverage. Most people don’t know, but uninsured motorist also covers hit and runs or parking lot dings.

    It is required by federal to atleast have liability (this is what pays if you hit someone). Full coverage or uninsured motorist is by state.

    It is incredibly unfortunate that a lot of Plaintiff law is like this.

    Years of expensive litigation and the injured party walks away with virtually nothing.

    Some states are better than others.

    In the province of Ontario you must provide proof of insurance (liability, uninsured motorist etc. minimum) at time of plate renewal. Also the police are tied into the insurance computers to verify if you have valid insurance at this exact moment in time. In the past people would cancel their insurance the day after they got a new sticker for their plates. Minimum fine for no insurance is $5000 for a first offense.

    Now if you have a lien (owe money / financing) on your vehicle you must have full coverage. Basically covers the banks liability in case of a loss.

    Okay, to Answer OPs question- probably not a total lost.

    The damage has to not exceeded 50% of the value.

    Here’s the obvious that needs replacement- bumper assembly/ cover, RT bedside sheet metal, RT fender flare, top plastic cap, RT rear tire ( amortize the life/ value ), RT rim, RT taillight, and associates fasteners- probably looking at 1.5k-2.3k material depending on what your carrier / shop chooses.

    Labor and paint -probably looking 2k-2.4k without supplement.

    Seeing an impact where it deforms the rear bumper- for sure I would check the trueness of frame as well.

    If your frame is jacked- well...you MAY have a loss cause the labor alone on that would be $$$$$

    Just heard from adjuster. If there's any frame damage it's done. He said they have to remove the bed and see the damage underneath to tell me for sure. On the surface looks like they can repair. Have to say a Chevy Tahoe hit it at 40 to 45 mph and the taco took it like a champ....
