Stopped by my truck to get a few things out. I noticed the bed actually struck the cab and went back is this normal place. It has a small dent and paint missing on the cab. He said they are about $6200 to repair without removing bed and checking the frame. Makes me sad it's a 2015 with only 26k miles.

    That is not too bad!

    $6200 seems about right.

Pretty sure only New Hampshire ( maybe Virgina?) doesnt make its driver carry liability insurance. Everyother state does.

I think Virginia has a $500 clause you pay if you decided to 'self insure' a vehicle at registration:

I feel your pain and frustration! My frame did end up being a few millimeters bent. Total repair costs were 15k. They still paid. 2015 4x4 sport

people still drive without insurance here. I've been hit by a guy that had no insurance. took him to court and he had to pay out of his pocket to fix my car and he had to pay my lawyer fees after the fact.

The shop was not able to take the bed off today. They said they are at $6,895 right now. I may hear from them tomorrow. Bad news was it will take 12 working days once they have all the parts, that's if there's no frame damage. He told me it would be first week of April before I can get it back.

Could you not just pay deductible, claim injury, loss of wages ect... and your insurance company deals with the courts on the other driver. Thought thats what insurance was for.

Not that easy you still have to pay deductible. I can file lawsuit against other driver but if they can't afford insurance you think they can afford to pay my deductible?

Yeah I get the deductible part. I thought it was up to the insurance company to file the lawsuit and take of that.

    Who's your insurance company?

I was making a left turn, and some drunk asshole in a Mercedes floored it through a stop sign going straight and almost ripped my rear bumper off.

I have USAA, and they had to pick up the tab for fixing my truck because Sir Drinks-A-Lot lied to his insurance company about the accident and they believed him. USAA waived the deductible and did not raise my rates.

The drunk guy who hit my truck back in 2015 had insurance, but he lied to his insurance company and said I ran a stop sign. His insurance company believed his story, despite the fact that he got his second DUI in about 30 years. If that's not bad enough, the asshole KILLED somebody while driving drunk the first time. He had served his time and had a valid license, but obviously did not learn his lesson. At least he only took out my left bed panel and rear bumper, and didn't take another innocent life this time. He was driving a 2002 Mercedes E320, and his car had moderate front end damage and a bent frame (he hit me HARD, luckily he hit me in such a way that I barely felt the impact and didn't get hurt).

My parents and I contacted our insurance company (again, USAA) the night the accident happened, because we knew this guy was going to fight it and might even come after me to pay for damages to his Mercedes. USAA looked at pictures I sent them of my truck, and at satellite images of the intersection where the accident took place. It did not take them long to determine that I was NOT at fault, even in the slightest.

So, Sir Drinks-A-Lot's insurance company sent an adjuster out to look at my Tacoma and was ready to write me a check for almost $3,000 to fix it, but they could not get reach the guy. I gave my statement to his insurance company, and they finally reached him about two weeks after the accident happened. He stuck to his story that I'd run a stop sign, and they believed him, even though he was facing DUI charges. His insurance called my parents' house and left a message since we weren't home, basically saying that our stories were different so they weren't going to pay for the damages to my truck. It's probably better that nobody was home when that call came in, especially me, because I probably would have cussed the poor bastard out and said some not-so-nice things...

So, we're getting close to Thanksgiving at this point, and I've got a smashed-up Tacoma that is damaged in such a way that the tailgate won't open all the way. I wanted my baby fixed, so we called up USAA and they decided to fix my truck and take the other guy's insurance company to court. My truck was fixed before Christmas, and they didn't take the drunk's insurance company to court until April. Even then, they couldn't agree on who was at fault and came to a draw. Basically, my insurance company ate the cost of fixing my Tacoma at no cost to me, and Sir Drinks-A-Lot's insurance paid to fix his Mercedes (or possibly replace it, since it was 13 years old at the time, had frame damage, and was possibly totaled). My rates still did not go up, and I still ended up getting the last laugh.

Sir Drinks-A-Lot lost his license for a year (I think it should have been permanently revoked), served time in jail, had to pay a substantial fine, and was ordered to pay me $500 in restitution. I used this restitution to buy a new stereo for my truck, and also invested in a dashcam so if some scumbag hit my truck again they couldn't lie about it...
