    The bank has no say in what is and isn't mandatory.

    Mandatory = Government. You must comply in order to drive.
    Optional = Bank. You don't need a car loan to drive.

    I think the point is that most banks require it. So if you want loan from them for a new car, it's mandatory.

    Like I said, a loan is NOT required to drive.
    You can drive without a car loan.
    You won't get a ticket at a traffic stop because you failed to comply with a bank stipulation.

    If you sign a contract with a bank saying you'll have it as long as the vehicle is financed, then it's legally mandatory.

    It falls under contract law, which is very different from criminal law.
    Your responsibility will be to the bank that is putting that stipulation into the contract.

    So to put this very simply; *you do not need to sign that contract*.
    In fact, if somebody is forcing you to sign that contract, then that contract is under duress, and therefore not enforceable.

    except if you go back to that top gear episode where they do all that at the end they explain how the frame is destroyed and it was the trucks body holding the frame together in stead of the other way around.

    and that was purely to prove that the hilux diesel engine was great reliability.


    But for the OP, ya once you have new gaps or old ones closed due to a collision thats usually frame damage, which usually means write off.

    I've talked to insurance brokers as well when I was searching for a better price.
    New cars get cheaper insurance because of stuff like this. the frames and bodies are designed to fail like this to absorb all the impact and not give it to the driver and occupants.

    reason being, totaled truck cost what 36K to the insurance? what does loss wages and physio bills cost. a simple fender bender with back or neck pain can turn into massive bills if the person can't work anymore until they are healed. Now you need to cover all the loss wages until the person is better etc.

    Wow. Going downhill fast... haha, at least it is entertaining.

    OP, sorry to hear that this happened. Shops can't move forward without approval, so it's crazy that he pulled the email bit and said you had 30 minutes to respond. Glad you have your truck to drive, but they should have put you in a rental car until you got the new frame. I guess every situation is different.

    I learned two lessons in regards to accidents. First, make sure your rental coverage covers a vehicle of the same size you have insured. My wife's car got hit, ford flex, we went to get the rental and they said we were only covered for a sub compact. WHAT! 5 people in a sub compact... ouch! I paid the $5 a day difference to get something we could fit in. Then I upped my rental coverage to cover a full size vehicle.

    A long time ago, I was in an accident like you, but I had three cars involved in hitting me. I went through my insurance and they had to go to court, seeing everyone was arguing at who was at fault for what damage. After three months, the judge ordered car #2 to pay for my damages and then they could figure out the rest later. I never, found out the final outcome, as soon as I was paid I didn't care. Having a good insurance company that stand for you it worth every penny. Using their shop that they garuntee the work for as long as you own the vehicle is also worth it.

    That sucks OP, especially on a new vehicle.


    Definition of mandatory:
    A mandatory action is something that is required, obligatory, or compulsory.

    Its very common for a bank to make it mandatory to carry insurance while you have a loan.

    in the process read reviews on said shop. They might just be guaranteeing the work because said shop either gives them a great price or a nice kick back on the repairs. I went through a guaranteed shop when I was rear ended.

    Well that shop said it was going to take 3 days to fix my bumper and trunk (trunk was just scratched). Took them 2 weeks in the process lied to me numerous times. Monday said it would be ready tuesday as the parts just came in and were painted that day and needed to dry then assemble. tuesday say the parts haven't come in yet.
    Wednesday say paint didn't come out right so they are repainting it. Thursday say parts just came in.
    Talked directly to the owner each time after the tuesday where I caught the main lady lying to me. In which the owner then lied constantly to me. Then offered to detail the car and left fingerprints all over the windows.

    When painting the trunk didn't think to remove the license plate lights and just taped them in a shit way so that now they are both pretty much half covered in paint. Didn't align the bumper properly either. All in all took me over a month to get them to finally align the bumper properly. They also decided to lie to me and say that my license plate lights no longer working was due to corrosion on the terminals yet I was able to put my toner on the terminals and find the wire broken right by where it follows the hinge on the trunk. They still never fixed it.


    So ya I wouldn't blindly think using a guaranteed shop is good without checking reviews. The shop I wanted to go to I have had do work for me out of insurance while restoring an older car. They did amazing work but insurance said it wasn't on the list and I'd need to pay out of pocket then wait to be reimbursed. Talked to my insurance company about it as well to give my feedback on the shop and asked how is this a guaranteed shop when they do such shotty work, the customer service rep I was talking to just said 'the shop gives us discounted prices so we use their work'
    Brother in law used this same shop for a repair as well and they didn't even align the fender properly or paint it the right color. Not a difficult color to match as it was factory paint for a nissan pathfinder. All in all if I ever need repairs again under insurance I will definitely not be bringing it back to this shop.

    Oh and in the process of finally getting them to align the bumper properly I had to leave the car for 2 days and was not given a rental or anything. Had to borrow someone's car to get to work.
