    The ACH bit is what I’m upset about. I’m an NFCU member and got both claims in for disputes prior to the filing, and they’re opening a ‘Reg E investigation’ for the April transaction that will take 10 days. I also had a PayPal dispute in as well, which they’re clearly not going to respond to in time before PayPal decides what to do.

    My other claim was within 60 days, so it was automatic reimbursement.

    I’ll report back what I hear from NFCU regarding their help for others. Keep in mind, both of my claims were in prior to the Ch. 7 filing. I also know a Ch. 7 lawyer, so I’m curious to hear what he says about them using customers as creditors in their filing. I’ll post back his legal opinion when I hear from him.

    Yea, doing ACH is what got me on this one, I always pay with CC and this one time I did ACH... lesson learned on that one... I would have already done the chargeback though my credit card by now if I had done CC. But will be going to my bank tomorrow and seeing if they are able to do anything. They are a Credit Union and have always helped on things, so who knows.

    Will report back with whatever they may need or want... or what they honestly say about everything.

    My PayPal dispute for the April charge has until 9/10, then they make determination. If they don’t help, Navy Federal Credit Union (NFCU) will hopefully lean into them.

    Going to be using my cards for everything like this now. Lesson learned. Worst part? I have a 0% card. Shows me for using cash.

    Best of luck to you. I use paypal and pay with credit a card through them. That way, I still get the miles and can have two methods of disputing charges.

    If anyone decides to call the FBI, I strongly recommend calling the office located in the same area that Pelfrey does business in, ask to speak to a financial crimes and or cyber agent as most orders were probably placed over the internet. It is possible that the bureau might have an investigation started already, all one can do at this point is call, looks like Pelfrey went rogue at some point and kept taking money eventhough they knew they were going down.

    I would also suggest everyone confirm they are in the filing. It appears they did not do full diligence and include everyone. I am not mentioned but did put a deposit down.

    @DoorDing Thank you for the warm welcome, obviously wish it was under different circumstances.... and you will be able to get your money back since it no doubt was a Third Party Provider, which they are bound to honor disputes for merchants they grant processing accounts to..

    @ETXTacoma no worries, glad to be of help, and you should push for a 'Reg E' investigation, the reason being the same as above, Third Party Providers of ACH merchant accounts are liable in the end for their merchants underneath them.. just because the merchant is into oblivion doesn't mean there is no recourse, you have a shot at it.. granted I am speaking just with info in this thread and not your whole story... like I said I would be glad to answer questions and review emails, documents, purchase receipts, etc to help with any individual questions via PM...

    I cannot guarantee much, but the best ammo is correct info on rules and regs, that turns you into a sharp-shooter.. because more often than not, people end up with the short end of the stick just through errors or unknowledgeable support staff on the other end of the telephone..

    This is the one area I think we're missing good information. How do you proceed or who do you contact if you're not listed as a creditor in the bankruptcy filing.

    Yah makes we wonder if you should be added or not as it technically precludes you from pursuing any damages if your on it or you just get pennies on the dollar. Not entirely sure but I am not included so if anyone has any advice that would be great. This may be the case for anyone who ordered other items at the time when they put down the deposit. When they gathered their "do not call list" for the filing these were probably missed as they were not labeled as just deposits.
