    Hey jason, its late, your prob not on anymore, but here we go.

    Its in my understanding that you have 15days to file reports etc etc with the police.

    Call the insurance asap. Leave a message and explain what's going on. Depending whom your through,and how cool your agent is it could go a lot of different ways.

    Most court records are public, free, and online. Search on google for the court/county etc etc, and look up the fuckers name, see if he has any past arrests etcetc.

    Sounds like a shitty situation. I was recently in an accident that while on paper is my fault, the driver whom I hit wants me to sue adot, and she wants to testify. I cannot afford that (or the risk).


    I will tell you that your gonna have to hunt for used parts. I went to what seems like all junkyards in the phx are lookn for parts. My neighbor (a worker at one) informed me that they are sold before they even get put on the lot by wholesaler/middle man parts companies. I found two auto second gen 4 runners. That was it. And they were just the basic body, and that's it.

    Get that camera going. I want one that records an hour and over writes it as it goes. In the case of accidents.

    I suggest opening up a word document, and typing down EVERYTHING you can remember while its fresh in your mind, that way, later on when your mind is focused on other things, you will have all the details on paper for yourself.

    Contact your insurance company, provide them the photos and your statement, let them go after the other guy and the other guys insurance. Call the local PD and file a report, give your statement so it is on file, then provide that to your insurance company as well. With that information, and the photos, they can tell by reviewing the damages and direction of the damage with who is at fault. Insurance does this for you, and I assume you have full coverage.

    You could pay your deduct, get the repairs taken care of, and let insurance fight it out. This way you're covered and you don't need to worry about the other hassle.

    Unless you can get the officer or a third party to support your side of the story i think you might be out of luck. I was in an incident sort of like that. This guy in a jeep hit the back right bedside of my truck in a parking lot as we were leaving (he was attempting to cut into the line of traffic) i had the right of way and didnt let him out, so he inched closer and closer till his metal bumper contacted my bedside. He tried to claim he was already half way out in the street when i tried to cut him off and go around him, which was a bad lie considering it was a tight 2 lane drive and i was not blocking the other lane at all, and that all of the damage was on the back bedside. Well the cop finally gets there and facilitates while we exchange info. Basicly it was a my word against his and if i couldnt prove it to the officer each individual would have to pay their own damages (zero for his metal bumper, 1000 for my bedside) so i was absolutely not going to pay for these repairs due to his aggressive driving and it being obviously his fault, so after many phone calls of threatening to take him to court and sue his ass for the repairs and putting the wreck on his insurance he agreed to pay the damages in full.

    What im getting at is that you will probably have to threaten to take him to court and hope he if he gives in and pays, or take him to court and hope you win and the vehicle damage proves he hit you.

    Good luck with it, the entire situation is FUBAR and i hope you get your truck back to looking perfect all on his dime!
