    On Thursday, March 17th, I was beaten and robbed at gunpoint of my 2016 Tacoma, $400 cash, and cell phone. The assailant took my truck on a pretty harsh joy ride trying to evade police, but somehow managed to get away. Both the assailant and his accomplice were arrested and put it jail four days later on Monday. This happened at a Jack in the Box parking lot in San Diego. Stay vigilant.

    Once they showed a weapon with intent, or began any type of assault that put you in fear of your life you have the right to defend yourself with deadly force if necessary....although in saving your own life and others the joy ride of you truck, 400 bucks and a cell phone was a cheap price to pay...glad they caught the bastards.

    Glad you're okay OP. I carry little to no cash at me at all times. I never put my vehicle in park in a drive thru. A buddy of mine was held at gunpoint at an ATM drive thru in San Bernardino (where I'm originally from..that's probably why I'm so vigilant.) Two guys actually jumped off the roof of the ATM awning and both landed by his front doors with handguns. He never put his vehicle in park so he pushed the guys hand and gun to the windshield and floored it and got out of there. Doubt they were ever found.

    HOLLY CRAP!!! Glad you walked away...... that is scary, I don't live in a big city but things are getting mad all over the place, last year someone broke in to my garage and stole my dirt bike, kind of know
    the feeling.
    Regards of whats mentioned above, I thing when you are gun point not much you can do, some time is just let it go.
    Again glad you are ok and holding up.

    I think in California, a vehicle that is stolen is considered salvaged...

    Obviously press charges and charge the full amount worth of replacing your vehicle and if you have a chance, buy it back at a cheaper price. Pay what you owe on the truck and the rest is history.

    What happens when you try to shoot the guy and miss, killing a person across the street? Not trying to start anything here, but just wondering. If I had a gun I'd be shooting the bastard and that thought wouldn't cross my mind. But what happens if....

    Which SD neighborhood OP? I'm in SD too. Glad you're alive.

    In california? I don't even want to imagine that. If you were in your car and shot just the person trying to steal your car, you'd probably end up with a felony and a civil lawsuit from the person's family (which you'd most likely lose). Yeah, it is that backwards.

    Assuming the armed citizen wasn't reckless, there's no criminal liability for missing if the use of force against the perpetrator was justified. The perp would likely be charged with felony murder in that scenario actually. I'd be more worried about the civil liability and personal guilt. Luckily armed citizens are far less likely to injure/kill bystanders than the police; I suspect this is because they usually have the benefit of context as to who is and isn't a BG whereas the police are often summoned to a scene that is already in progress.

    you would be correct about that. In California the rights of the criminal > rights of the victim......thank the liberal extremists for that one. Texas is so much more "logical" on that then California is.
