    I feel for the homeowner, but congratulate him as well. Shooting a kid regardless of the circumstances cannot be erased from the mind. Still, raising the percentages of getting shot for committing a burglary... well, even the most ignorant punks should think about it.

    you can shoot someone in the back in certain cases per Tenn. v. Garner

    Under U.S. law the fleeing felon rule was limited to non-lethal force in most cases by Tennessee v. Garner, 471 U.S. 1 (1985). The justices held that deadly force "may not be used unless necessary to prevent the escape and the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others."




    I'm all for homeowners and citizens defending themselves but you need to remember that even if youre in this guy's shoes...you need to be able to articulate the reason for deadly force

    Typically courts look for 3 things to see if deadly force was necessary or legally used

    Ability
    Opportunity
    Jeopardy

    while I'm not arguing for the knucklehead...the homeowner cannot really articulate jeopardy if the dude was on his porch...

    to all the people saying it is illegal to shoot them in the back, does that only apply if they are outside the house? i mean if i hear someone coming in and i grab my 40 from my bedside and look out my door and someone is walkin into my sisters room, im going to shoot. or even if they are downstairs and i happend to look over the side of the loft and see them and shoot them is that bad? am i required to make fun of their mother to make them turn around before i shoot them?

    i think you'd be ok in that situation because at that point you're still protecting life and theyre not attempting to flee
