A gun color alone is rarely the issue of conviction alone, however if you have a blinged out or “tactical weapon” it is used against you in proving intent and your state of mind as NOT being the victim protecting themselves. If you have to explain your modifications to your defense team, it’s probably going to hurt you. “I like Gucci guns” is not a defense.

I don't want to start shit, just thought it was a valid point in a life changing event. All my weapons (even all my screwdrivers) were also lost in a tragic canoeing incident so I have no skin in the game any longer. I still have nightmares of my poor poor darlings.

 

I’d be open to that as I’m not a lawyer either, I just know my state, and the states I travel to laws, but more importantly how things really work. I should of listed from the handful of cases I had pulled up to see what states they were in but there’s a lot of people who beat criminal cases, then got sued by the persons family for wrongful death or some shit like that.. kind of pissed me off skimming through it.

 

I’m not sure if I think color would be a huge factor BUT the punisher, confederate flag, or anything that makes it seem you’re likely to shoot first, can’t help your case. Might or might not hurt it, but it certainly won’t help.

Actually we typically carry black guns to be uniform, my agency allows me to carry my personal firearm (the requirement being It’s from an approved manufacturer) and if we want a patrol rifle we have to supply it ourselves (also an approved manufacturers list) but we don’t have limitations on colors or anything like that, just a rule of no suppressors (probably the biggest disagreement I have with policy, if I’m going into an active shooter with my patrol rifle let me use my suppressor also, I want to be able to hear dispatch and my coworkers) and no full auto.

The gun had nothing to do with Fishs case. Dude got scared of two off leash dogs, then shot their owner who rightfully ran towards him to figure out what the fuck just happened.

 

Yep, then he got fired for that etching, luckily it got thrown out of discovery in criminal trial. It was never presented to the jury. Then he got rehired. Then got medically released for “ptsd”. Then got a pension, and was bankrupt, while his dept got sued for a settled 1 mil. That’s what happens when your boys look out for you even in public opinion. And there in lies my point. Had he not had it, he would just have just had to explain where his head was and not put his dept. in that position, and in another circumstance like an off-duty incident, if there was room for wiggle in his story, it could have easily been him to be sued, not the police department. I’m not worried about a criminal case in the court of public opinion so much as the standard is set at reasonable doubt. If the circumstance are pure and it’s a clean shoot that will speak most to a jury, a reasonable unbiased jury anyways.

I’m worried about the lawsuit, which is a thing in my state, where the the burden of proof is much lower, and does not have to be criminal. I know what it’s like to pay for a lawyer. I wouldn’t have much to give if I got a lawsuit slapped on too, because some gun hating hard left leaning judge found out that my gun was gold tin coated and it looked “gangster” (no I don’t have a gold gun). I don’t trust people where my fate is in their hands to be “reasonable.” So I don’t give them a reason to single me out with moron labe, and tactical motto shit on my truck and guns, no OEF, no stupid ass combat action ribbon decal, nothing. I have an applied ballistics sticker on my safe, and neutral colors coatings on my home guns. Carry guns are stock, but most because that’s how they were registered based on the requirements, and already had tritium sights. Our IA checks trigger pull in my county. Hunting rigs are cerakoted by yours truly, my comp and range guns are special purpose based so they look cool but are 100% purpose built. Mostly neutral colors. Another guy that didn’t get convicted was Florida vs Luis Alvarez who had a coil and a half snipped from his trigger spring. Shot a dude in the face on legit accident. Robert Tessitore Case where the prosecution tried to say his laser on his pistol was used to hunt humans. Just saying, it’s possible that anything on the firearm will be used against you if possible if the case is high profile enough in any form of court, just to see if it sticks.

 

I think this is a pretty good statement. The anti-gun movement jumps on any case they can to push bans on “assault” weapons. Again, not sure how much it matters in the grand scheme of things, but it certainly won’t help your case any. Also, you know anything the prosecution or media can key in on, they will. Overly pro gun statements, memes, etc.

Just look at Amber Guyger and how her Facebook was used by the media. Yeah she was a dumbass, but I’d be willing to bet that on our best day, all of us have something we have posted that could skew public opinion. That’s when attempt to use some form of tact.

I think it’s just a good point about protecting yourself in the event you did have to shoot.
