I think so, I believe people are removing the shoes before burning.

 

If I were you (in the same state as Pelfrey) I would go sign Criminal “Theft by Deception” complaints against all of the people you can name from the company. That should get some attention.

 

I also contacted Wells Fargo again today (following up from my initial claim last week) and when I spoke with them they stated that since it was ACH and I authorized the transaction for a sale of "goods that I never received" then most likely I will have to resolve it with the company.

...HOWEVER, they sent the claim to an investigator who will contact me if there's any questions.
From there I'll be sure and tell them about the failed communication throughout our business.

If you lost several thousand dollars I believe investigating taking a deduction on your income tax is worth the effort.

Nonbusiness Bad Debts - All other bad debts are nonbusiness. Nonbusiness bad debts must be totally worthless to be deductible. You can't deduct a partially worthless nonbusiness bad debt.

A debt becomes worthless when the surrounding facts and circumstances indicate there's no reasonable expectation that the debt will be repaid. To show that a debt is worthless, you must establish that you've taken reasonable steps to collect the debt. It's not necessary to go to court if you can show that a judgment from the court would be uncollectible. You may take the deduction only in the year the debt becomes worthless. You don't have to wait until a debt is due to determine that it's worthless.

Report a nonbusiness bad debt as a short-term capital loss on Form 8949.pdf, Sales and Other Dispositions of Capital Assets, Part 1, line 1. Enter the name of the debtor and "bad debt statement attached" in column (a). Enter your basis in the bad debt in column (e) and enter zero in column (d). Use a separate line for each bad debt. It's subject to the capital loss limitations. A nonbusiness bad debt deduction requires a separate detailed statement attached to your return. The statement must contain: a description of the debt, including the amount and the date it became due; the name of the debtor, and any business or family relationship between you and the debtor; the efforts you made to collect the debt; and why you decided the debt was worthless.

Basis in the Debt
To deduct a bad debt, you must have a basis in it—that is, you must have already included the amount in your income or loaned out your cash. Thus, for example, you cannot claim a bad debt deduction for unpaid alimony owed by your former spouse. If you are a cash method taxpayer (as almost all individuals are), you cannot take a bad debt deduction for unpaid salaries, wages, rents, fees, interest, or dividends. This is true even though they are owed to you. On the other hand, you can take a bad debt deduction for the amount you deposit with a contractor if the contractor goes broke and you are unable to recover your deposit. If the deposit is for work unrelated to your trade or business, it is a nonbusiness bad debt deduction.

I just received this in the mail today.
I blurred out their social security numbers and home address for obvious reasons.

 

Along with the Wells Fargo disputes that are open, I looked at my Paypal invoice for the rear bumper ($2,099) dated May 21, 2018. In fine print at the bottom, the invoice allows you to open a dispute on the charge up to 180 days from the transaction date. It gas been 113 days so I called Paypal.

They stated that regardless of how Pelfreybilt has filed bankruptcy, that they give them 10 business days to respond to their request, and on that 11th day if they have not answered then I will be credited the full amount into my Paypal account.

Lets sure hope that this is how it works because I made sure to voice my concerns and doubt regarding the money coming back to me and they sounded confident that I would get the money credited back...

 

Paypal has always been good to me with getting my money back when they said they would. Actually I have never not been refunded when I open a case.

 

That's reassuring, now I wish I would've had Pelfreybilt send me a Paypal invoice for the skids I added on August 27th..... oh well, I'll chalk it up as a big WIN if I can get $2,100 of the $2,425 total refunded back to me *deep sigh*

Sorry about that. I really feel for you guys, I almost bought skids from them too back on December, and was going to get armor later on from them also, but luckily they never sent me a reply to my emails inquiring about driving there to pickup items so I decided to look elsewhere and found a couple of great TW vendor builders. I came so close to blowing it on this company. I hope everyone here gets some sort of refund. I see civil small claims lawsuits comming if the judge denies the BK due to “issues” with the filing.

 

Plaintiff lawyers are contingency based.

Pretty sure the costs of filing in small claims exceed $1,000 which is all he’s entitled to.
There are no non-economic damages in bankruptcy cases.

You cannot get blood from a turnip.
You can’t sue people for money they don’t have.
That’s what makes this so tragic. Victims don’t have much of a recourse.

It would be great if we could do a go fund me type of thing here.
I’m proud of the vendors that are offering serious discounts for those effected.

 

Like I said his only option was to hire a lawyer and sue the corporation (Pelfreybilt), I never said it would be cost effective though.

Are you a lawyer in California? That would really help everyone out to have some expertise if you are. Otherwise it’s just another random person not knowing what they are talking about.
